【摘要】：外來物種入侵不僅損害生物多樣性，破壞生態(tài)平衡，而且阻礙社會經濟的可持續(xù)發(fā)展，甚至會對人的身體健康造成一定的影響。早在20世紀50年代，外來物種入侵的問題就已經引起了部分國家和地區(qū)的關注，1992年里約熱內盧聯(lián)合國環(huán)境與發(fā)展大會之后，外來物種入侵問題在全球范圍內引起了廣泛的關注，國際社會包括很多國家開始逐漸有計劃的采取行動。這些國際行動推動了我國對外來物種入侵問題的認識，并逐漸促使我國在法律法規(guī)方面采取必要措施，但是，到目前為止，我國對防治外來物種的入侵還沒有一套完善的立法體系，與國外立法發(fā)展迅速的國家相比，，法律制度的缺失，勢必會造成防治外來物種入侵相關措施的不足。因此，本文通過研究國際公約等國際社會所取得的成果以及外國防治外來物種入侵的相關立法，分析我國能夠借鑒的先進經驗，構建我國防治外來物種入侵的法律體系，使防治外來物種入侵工作步入規(guī)范化、法制化的軌道。該論文主要包括以下內容： 1.闡述外來物種入侵的含義。結合國際公約的規(guī)定和國外的立法，首先，解釋外來物種及外來入侵物種的法律含義；其次，分析外來物種入侵與生物入侵的關系和相關概念的區(qū)別，從基本和關鍵概念界定上保證防治外來物種入侵立法的嚴謹性。 2.提出對我國防治外來物種入侵立法理論的思考。分別從防治外來物種入侵立法的法理學理論基礎、生態(tài)倫理學理論基礎兩個方面提出我國防治外來物種入侵立法的理論依據(jù)。 3.介紹及分析防治外來物種入侵的國際及國外立法發(fā)展狀況及經驗。首先介紹目前有關防治外來物種入侵的國際公約和其他國際組織的相關行動；其次，介紹歐盟及歐洲其他國家、美國、日本等國家的法律制度，分析這些國家在防治外來物種入侵立法方面所具有的特點及在相關法律制度方面所取得的顯著成果。再次，總結國際及國外立法的經驗教訓，并提出這些立法與實踐活動對我國防治外來物種入侵立法的啟示。 4.通過借鑒國外的先進經驗以及結合我國外來物種入侵造成的影響，對我國防治外來物種入侵立法的構建提出建議。具體從立法目的、法律原則、法律制度、行政監(jiān)督管理體制、法律責任體系五個方面進行了分析。
[Abstract]:The invasion of alien species not only damages biodiversity and ecological balance, but also hinders the sustainable development of social economy, and even has a certain impact on human health. As early as the 1950s, the problem of alien species invasion has attracted the attention of some countries and regions. After the United Nations Conference on Environment and Development in Rio de Janeiro in 1992, the problem of alien species invasion caused widespread concern in the world. The international community, including many countries, began to act in a gradual and planned manner. These international actions have contributed to our understanding of the problem of invasive alien species and have gradually prompted our country to take the necessary measures in terms of laws and regulations, but so far, There is not a perfect legislative system for the prevention of invasive alien species in our country. Compared with the countries with rapid development of foreign legislation, the lack of legal system will inevitably lead to the shortage of measures related to the prevention and treatment of invasive alien species. Therefore, by studying the achievements of the international community such as international conventions and the relevant legislation of foreign countries to prevent alien species invasion, this paper analyzes the advanced experience that our country can learn from, and constructs the legal system of preventing and controlling alien species invasion in our country. The prevention and treatment of invasive alien species into the standardized, legalized track. This paper mainly includes the following contents: 1. Expound the meaning of alien species invasion. Combined with the provisions of international conventions and foreign legislation, firstly, it explains the legal meaning of alien species and alien invasive species; secondly, it analyzes the relationship between alien species invasion and biological invasion and the difference of related concepts. The definition of basic and key concepts ensures the rigour of legislation against invasive alien species. 2. This paper puts forward some thoughts on the legislative theory of preventing and controlling alien species invasion in China. This paper puts forward the theoretical basis of preventing alien species invasion legislation in China from two aspects: the legal theoretical basis and the ecological ethics theoretical basis of the legislation on the prevention and control of alien species invasion. 3. This paper introduces and analyzes the status and experience of international and foreign legislation on the prevention and control of invasive alien species. First, introduce the current international conventions on the prevention and control of invasive alien species and related actions of other international organizations; secondly, introduce the legal systems of the European Union and other European countries, the United States, Japan and other countries. This paper analyzes the characteristics of the legislation on the prevention of invasive alien species in these countries and the remarkable achievements in the relevant legal systems. Thirdly, it summarizes the experience and lessons of international and foreign legislation, and puts forward the enlightenment of these legislation and practice to the legislation of preventing alien species invasion in China. 4. By drawing lessons from the advanced experience of foreign countries and combining the influence caused by alien species invasion in China, the paper puts forward some suggestions on the construction of legislation to prevent alien species invasion in China. It analyzes the legislative purpose, legal principle, legal system, administrative supervision and management system and legal responsibility system.
