【摘要】:作為一種特殊的海上侵權行為,船舶碰撞導致的油污損害事故因其造成的經(jīng)濟損失巨大,已經(jīng)受到國際社會的普遍關注。本文以《船舶碰撞油污損害責任主體及歸責原則研究》為題,以侵權法基礎理論為支撐,以國際公約和我國相關法律法規(guī)中有關船舶碰撞油污損害的規(guī)定為基礎,結合我國船舶碰撞油污損害賠償?shù)乃痉▽嵺`,對船舶碰撞油污損害責任主體及歸責原則這一論題進行了比較全面的系統(tǒng)化研究,并針對目前我國船舶碰撞油污損害賠償責任制度中存在的問題與不足,提出了修改和完善的建議,以求能夠有助于我國船舶碰撞油污損害賠償法律制度的建設。 本文首先對船舶碰撞造成油污損害這一行為的性質(zhì)進行了分析,認為它是一種特殊的侵權行為,然后介紹了船舶油污損害、責任主體及歸責原則等一些基礎概念理論。 其次,本文對國際公約,主要是1969/1992年《民事責任公約》、2001年《燃油公約》進行了介紹,分析討論了其中有關責任主體及歸責原則的規(guī)定 第三,在研究了我國船舶碰撞油污損害案件的法律適用后,對比相關國際公約中的規(guī)定,本文分析討論了我國法律法規(guī)中有關船舶碰撞造成油污損害的責任主體及歸責原則的規(guī)定。 最后,以前三章的分析為基礎,針對本文的論述提出船舶碰撞造成油污損害的法律建議和應采取的措施。希望能通過建立和完善我國船舶油污損害賠償法律制度,以解決當前船舶碰撞造成油污損害的賠償責任問題。
[Abstract]:As a special tort at sea, the oil pollution damage caused by ship collision has been paid more and more attention by the international community because of its huge economic losses. In this paper, the subject of liability and the principle of imputation of ship collision oil pollution damage are taken as the title, supported by the basic theory of tort law, and based on the provisions of international conventions and relevant laws and regulations of our country concerning ship collision oil pollution damage. Combined with the judicial practice of compensation for oil pollution damage caused by ship collision in China, this paper makes a comparatively comprehensive and systematic study on the subject of liability for oil pollution damage caused by ship collision and the principle of imputation. Aiming at the problems and deficiencies in the liability system of ship collision oil pollution damage compensation in our country, this paper puts forward some suggestions for modification and perfection in order to be helpful to the construction of the legal system of ship collision oil pollution damage compensation in our country. In this paper, the nature of oil pollution damage caused by ship collision is analyzed, which is considered as a special tort, and then some basic concept theories such as oil pollution damage, liability subject and liability principle are introduced. Secondly, this paper introduces the international conventions, mainly the Civil liability Convention of 1969 / 1992 and the Oil Convention of 2001, and analyzes and discusses the provisions on the subject of liability and the principle of liability imputation. Third, after studying the application of the law in the case of oil pollution damage caused by ship collision in China, the provisions of the relevant international conventions are compared. This paper analyzes and discusses the provisions of the laws and regulations of our country concerning the subject of liability and the principle of imputation of oil pollution damage caused by ship collision. Finally, based on the analysis of the previous three chapters, the paper puts forward some legal suggestions and measures for oil pollution damage caused by ship collision. It is hoped that the legal system of compensation for oil pollution damage caused by ship collision can be established and perfected in order to solve the problem of liability for oil pollution damage caused by ship collision.
