【摘要】： 鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法是指國家機構(gòu)依法創(chuàng)制、修改、廢止關(guān)于鄉(xiāng)鎮(zhèn)環(huán)境保護管理活動的有關(guān)法律、法規(guī)、規(guī)章和規(guī)范性文件的活動,以及這種活動最終形成的法律、法規(guī)、規(guī)章和規(guī)范性文件體系�，F(xiàn)行鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法初具雛形,形成了包括國家和地方兩個層面,由憲法、法律、行政法規(guī)和地方性法規(guī)、部門規(guī)章和地方人民政府規(guī)章以及規(guī)范性文件等組成的多層次體系,在內(nèi)容上可以分為鄉(xiāng)鎮(zhèn)環(huán)境保護管理組織立法、職責立法、職權(quán)立法和責任立法等四個部分。但是,現(xiàn)行鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法還存在不同層次立法之間不協(xié)調(diào)、不同部門立法之間不銜接、若干必要內(nèi)容欠缺、部分重要內(nèi)容重復(fù)、與現(xiàn)行有效管理制度缺乏銜接等諸多缺陷。鄉(xiāng)鎮(zhèn)環(huán)境保護管理實踐的很不發(fā)達、我國環(huán)境保護立法理念的偏差、鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法研究的薄弱等因素共同決定了鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法所存在的缺陷。《城鄉(xiāng)規(guī)劃法》和《水污染防治法》分別從職權(quán)、職責等方面對鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法作出新的發(fā)展。 完善鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法是重視鄉(xiāng)鎮(zhèn)環(huán)境保護管理工作,建設(shè)鄉(xiāng)鎮(zhèn)環(huán)境保護管理隊伍,完善鄉(xiāng)鎮(zhèn)環(huán)境保護管理投入,規(guī)范鄉(xiāng)鎮(zhèn)環(huán)境保護管理行為,滿足公眾環(huán)境保護要求,實施鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法,完善環(huán)境保護法律體系構(gòu)建,改革環(huán)境保護管理體制立法的要求和需要。鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法的內(nèi)在合理性,國家環(huán)境保護政策的發(fā)展,各地鄉(xiāng)鎮(zhèn)環(huán)境保護管理的實踐以及國外鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法的經(jīng)驗共同構(gòu)成了完善鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法的可行性基礎(chǔ)。 鄉(xiāng)鎮(zhèn)環(huán)境保護管理應(yīng)該采取分散立法、以行政法規(guī)和地方性法規(guī)為主,包括鄉(xiāng)鎮(zhèn)環(huán)境保護管理各方面內(nèi)容,協(xié)調(diào)、統(tǒng)一的立法模式;充分體現(xiàn)鄉(xiāng)鎮(zhèn)環(huán)境保護管理的特色,全面覆蓋鄉(xiāng)鎮(zhèn)環(huán)境保護管理組織立法、職責立法、職權(quán)立法、責任立法和相關(guān)立法等內(nèi)容。完善鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法應(yīng)遵循合法性、實效性、協(xié)調(diào)性等原則;并通過加強鄉(xiāng)鎮(zhèn)環(huán)境保護管理立法研究,明確國家有關(guān)鄉(xiāng)鎮(zhèn)環(huán)境管理政策,采取合適的完善策略等路徑來實現(xiàn)。
[Abstract]:The legislation on environmental protection and management in towns and townships refers to the activities of the relevant laws, regulations, regulations and normative documents concerning the environmental protection and management activities of townships created, revised and abolished by state agencies according to law, as well as the laws and regulations resulting from such activities, System of regulations and normative documents The current legislation on environmental protection and management in townships is in its infancy and has formed at the national and local levels, consisting of the constitution, laws, administrative regulations and local laws and regulations, The multi-level system composed of departmental regulations, rules of local people's governments and normative documents can be divided into four parts: the legislation of environmental protection and management organizations in villages and towns, the legislation of duty, the legislation of authority and the legislation of responsibility. However, the current legislation on environmental protection and management of villages and towns is still not coordinated among different levels of legislation, does not link up with legislation of different departments, lacks some necessary contents, and repeats some important contents. Lack of convergence with the current effective management system and many other defects. The practice of environmental protection management in villages and towns is very underdeveloped, and the deviation of the concept of environmental protection legislation in China, The weakness of the legislation on environmental protection and management in towns and villages together determines the defects of the legislation on environmental protection and management in towns and townships. The Urban and Rural Planning Law and the Water pollution Prevention and Control Law have their respective functions and powers. Responsibilities and other aspects of the township environmental protection and management legislation to make new development. To perfect the environmental protection management legislation of villages and towns is to attach importance to the environmental protection management of towns and townships, to build the environmental protection management team of towns and villages, to perfect the investment of environmental protection management in towns and villages, to standardize the environmental protection management behaviors of towns and villages, and to meet the requirements of public environmental protection It is necessary to implement the legislation of environmental protection management in villages and towns, perfect the legal system of environmental protection, and reform the legislation of environmental protection management system. The inherent rationality of the environmental protection management legislation in towns, the development of the national environmental protection policy, The practice of environmental protection and management in villages and towns and the experiences of foreign countries constitute the feasible basis for perfecting the legislation of environmental protection management in villages and towns. The environmental protection management of villages and towns should adopt decentralized legislation, mainly administrative regulations and local laws and regulations, including various aspects of environmental protection management in towns and villages, coordinate and unify the legislative model, fully reflect the characteristics of environmental protection management in towns and villages. Comprehensive coverage of the township environmental protection management organization legislation, duty legislation, authority legislation, responsibility legislation and related legislation and so on.
