【摘要】： 當(dāng)代中國(guó)的核心詞匯是“發(fā)展”與“和諧”,也即我們不僅要發(fā)展還要可持續(xù)地發(fā)展,要為子孫后代的發(fā)展留下空間,這需要我們處理人類社會(huì)與自然的關(guān)系時(shí)以和諧作為標(biāo)準(zhǔn)。促進(jìn)人與自然關(guān)系和諧發(fā)展不僅成為執(zhí)政黨的綱領(lǐng)而且上升到國(guó)家發(fā)展的基本國(guó)策,但是在落實(shí)這一綱領(lǐng)、政策的過(guò)程中我們發(fā)現(xiàn)我國(guó)的很多制度、措施是在舊發(fā)展觀指導(dǎo)下制定的,已經(jīng)不能適應(yīng)和諧發(fā)展觀的要求。而我國(guó)的環(huán)境問(wèn)題日益嚴(yán)峻,因此,構(gòu)建一種符合和諧發(fā)展觀要求的環(huán)境管理法律制度將對(duì)建設(shè)生態(tài)文明、和諧社會(huì)和法治國(guó)家起到積極作用。 人口、科學(xué)技術(shù)、經(jīng)濟(jì)發(fā)展方式是影響環(huán)境的三個(gè)最重要因素,而在我國(guó)這三個(gè)因素同時(shí)存在并各具特色。人口、科學(xué)技術(shù)和經(jīng)濟(jì)發(fā)展方式的共同作用使我國(guó)的環(huán)境問(wèn)題容易發(fā)生而難以有效解決。作為解決環(huán)境問(wèn)題的主要社會(huì)制度之一,我國(guó)目前的環(huán)境管理法律制度本身存在著嚴(yán)重的缺陷與不足,無(wú)法適應(yīng)當(dāng)前社會(huì)發(fā)展的需要。因此,基于人與自然和諧發(fā)展的理念,必須確立一種新型的人與自然權(quán)利義務(wù)關(guān)系模式,并在此模式下構(gòu)建“環(huán)境標(biāo)準(zhǔn)人制度”這一嶄新的環(huán)境管理法律制度體系。 通過(guò)應(yīng)用理論研究方法、實(shí)證研究方法以及經(jīng)濟(jì)分析的方法,文章分析了建立環(huán)境標(biāo)準(zhǔn)人制度的必要性和可行性,并嘗試構(gòu)建了環(huán)境標(biāo)準(zhǔn)人制度體系。具體而言,環(huán)境標(biāo)準(zhǔn)人制度指的是為了保護(hù)環(huán)境、節(jié)約資源和保證人類社會(huì)與自然界的可持續(xù)發(fā)展而規(guī)定的社會(huì)主體占有、使用自然環(huán)境資源標(biāo)準(zhǔn)的制度體系。環(huán)境標(biāo)準(zhǔn)人制度包括環(huán)境標(biāo)準(zhǔn)人的主體制度、環(huán)境資源權(quán)利流轉(zhuǎn)制度等。環(huán)境標(biāo)準(zhǔn)人制度是一個(gè)龐大的制度體系,影響該制度實(shí)施的因素很多,包括人口總量以及地域分布、環(huán)境資源總量、社會(huì)文化價(jià)值觀念以及科技因素等,因此它的建立需要根據(jù)當(dāng)時(shí)當(dāng)?shù)氐膶?shí)際情形分階段分步驟進(jìn)行,以期實(shí)現(xiàn)自然環(huán)境資源、經(jīng)濟(jì)與社會(huì)的和諧發(fā)展。環(huán)境標(biāo)準(zhǔn)人制度的建立對(duì)于對(duì)于推進(jìn)環(huán)境法理論發(fā)展完善、維護(hù)社會(huì)正義、保持社會(huì)公平,對(duì)于社會(huì)經(jīng)濟(jì)的均衡、可持續(xù)發(fā)展以及改變社會(huì)生產(chǎn)方式、提高人民生活福利都具有十分重要的意義。
[Abstract]:The core vocabulary of contemporary China is "development" and "harmony". In other words, we should not only develop but also develop sustainable development, and leave space for the development of future generations. It needs harmony as a standard when we deal with the relationship between human society and nature. In the process of implementing this programme, we have found that many systems in our country have been formulated under the guidance of the old concept of development and can not meet the requirements of the concept of harmonious development, and the environmental problems in our country are becoming increasingly serious. The legal system will play an active role in building an ecological civilization, a harmonious society and a country under the rule of law.
Population, science and technology and the way of economic development are the three most important factors that affect the environment, while the three factors exist and have their own characteristics in our country. The common effects of population, science and technology and the way of economic development make the environmental problems of our country easy to happen and are difficult to solve effectively. As one of the main social systems to solve the environmental problems, The current legal system of environmental management in our country has serious defects and shortcomings, which can not adapt to the needs of the current social development. Therefore, based on the concept of harmonious development between human and nature, a new model of the relationship between human and natural rights and obligations must be established, and the new ring of "environmental standard man system" is constructed under this model. The legal system of border management.
Through the application of theoretical research methods, empirical research methods and economic analysis methods, the article analyzes the necessity and feasibility of establishing the environment standard human system, and attempts to build an environmental standard system. In particular, the environmental standard person system refers to protecting the environment, saving resources and guaranteeing human society and nature. The social subject of the sustainable development is occupied by the social subject and the system of the standard of natural environment resources. The environmental standard person system includes the main body system of the environment standard person and the circulation system of environmental resources rights. The environmental standard person system is a huge system system. There are many factors affecting the implementation of the system, including the total population of the system. And regional distribution, the total amount of environmental resources, social and cultural values and scientific and technological factors, so its establishment needs to be divided step by step according to the actual situation at that time, in order to realize the natural environment resources and the harmonious development of economy and society. The establishment of the standard of environmental standards has developed for the development of the theory of environmental law. Good, maintaining social justice and maintaining social fairness are of great significance for the balance of the social economy, the sustainable development, the change of the way of social production and the improvement of the welfare of the people.
