【摘要】： 撓力河自然保護(hù)區(qū)位于黑龍江省三江平原上,是國(guó)家級(jí)自然保護(hù)區(qū),撓力河濕地是典型的低濕高寒濕地生態(tài)系統(tǒng),區(qū)內(nèi)動(dòng)植物資源非常豐富,保護(hù)區(qū)為各種依賴(lài)濕地環(huán)境生存、棲息的野生生物種群,特別是具有國(guó)際重要意義的野生動(dòng)物的棲息、繁衍提供了生活場(chǎng)所。保護(hù)區(qū)幾乎包含了三江平原濕地生態(tài)系統(tǒng)的所有類(lèi)型,具有未被破壞保持完整的原始生態(tài)系統(tǒng),是我國(guó)乃至世界同等濕地類(lèi)型較為齊全,保持較為完好的原始濕地之一,具有典型性、稀有性、多樣性和自然性的特點(diǎn)。保護(hù)區(qū)濕地調(diào)節(jié)三江平原氣候,對(duì)三江平原農(nóng)業(yè)發(fā)展有重大意義。但是,但受三江平原開(kāi)墾、無(wú)計(jì)劃開(kāi)荒、法律法規(guī)欠缺等因素影響,撓力河自然保護(hù)區(qū)濕地面積連年遞減,濕地生態(tài)環(huán)境日漸惡化。同時(shí),保護(hù)區(qū)內(nèi)野生動(dòng)植物資源迅速減少,生物多樣性保護(hù)令人擔(dān)憂(yōu)�？梢哉f(shuō),撓力河自然保護(hù)區(qū)濕地正面臨著嚴(yán)峻的生存威脅。因此,制定一部專(zhuān)項(xiàng)立法來(lái)保護(hù)撓力河自然保護(hù)區(qū)濕地生態(tài)環(huán)境、保護(hù)生物多樣性已迫在眉睫。 論文的中心論題很明確,即為研究制定一部撓力河自然保護(hù)區(qū)濕地保護(hù)的地方法規(guī)提出立法設(shè)想。基于此,文章共分五個(gè)部分,第一部分是緒論,總體介紹國(guó)內(nèi)外濕地保護(hù)相關(guān)法律法規(guī),和本文的研究意義目的；第二部分介紹的是本法的調(diào)整對(duì)象—撓力河自然保護(hù)區(qū)濕地的概況,生態(tài)價(jià)值,存在的問(wèn)題；第三部分分析了制定本條例的必要性和可行性；第四部分闡述了制定這部法規(guī)可借鑒的國(guó)際上的經(jīng)驗(yàn)和先進(jìn)做法；第五部分是論文的重點(diǎn)和核心,具體提出了制定這部地方法規(guī)的立法的設(shè)想,包括本法規(guī)的立法思想、目的、基本原則、基本制度和法律責(zé)任等規(guī)定,在立法框架和制度設(shè)計(jì)上力求做到既有具體保護(hù)制度,又有監(jiān)管措施和責(zé)任規(guī)定,既保證對(duì)濕地資源的合理利用,更要突出對(duì)濕地資源的全面保護(hù),使撓力河自然保護(hù)區(qū)的濕地保護(hù)走上法制化軌道。
[Abstract]:The Nagi River Nature Reserve is located in the Sanjiang plain of Heilongjiang province. It is a national nature reserve. The Nu Li River wetland is a typical low humid and high cold wetland ecosystem. The plant and animal resources are very rich in the area. The protected area is a wild species group, especially the wild animals with international importance. The protection area contains almost all types of wetland ecosystem in Sanjiang plain, which has undamaged and intact primitive ecosystem. It is one of the more complete wetland types in China and in the world, one of the relatively intact primitive wetlands, which is typical, rarity, diversity and naturalness. The wetland of the protected area regulates the climate of the Sanjiang plain, which is of great significance to the agricultural development of the Sanjiang plain. However, it is affected by some factors such as the reclamation of the Sanjiang plain, the lack of planning, the lack of laws and regulations and so on. The wetland area of the Nu Lihe nature reserve is declining for a year and the ecological environment of the wetland is deteriorating. At the same time, the wildlife resources in the protected area are fast. The rapid decrease and biodiversity conservation are worrying. It can be said that the wetland in the Nyali nature reserve is facing a severe survival threat. Therefore, it is imminent to establish a special legislation to protect the wetland ecological environment in the nimi nature reserve and protect biodiversity.
The central topic of the paper is very clear, that is to study and formulate a legislative idea of the local laws and regulations for the protection of wetland in Nu Li River Nature Reserve. Based on this, the article is divided into five parts. The first part is the introduction, the general introduction of relevant laws and regulations of wetland protection at home and abroad, and the purpose of this study; the second part is the introduction of this law. The adjustment object - the general situation of the wetland in Nu Li River Nature Reserve, the ecological value and the existing problems; the third part analyses the necessity and feasibility of formulating this regulation; the fourth part expounds the international experience and advanced practice that can be used for reference in the formulation of this regulation; the fifth part is the key and the core of the paper, and puts forward the system in detail. The legislation of the local laws and regulations, including the legislative ideas, objectives, basic principles, basic systems and legal responsibilities of the legislation, is designed to achieve both the specific protection system and the regulatory measures and responsibilities in the legislative framework and system design, not only to ensure the rational use of wetland resources, but also to highlight the wetland resources. The comprehensive protection will enable the wetland protection in the Nu Lihe River Nature Reserve to go on the legal track.
