【摘要】：隨著我國經(jīng)濟(jì)和社會的全面發(fā)展,人們的生活水平的不斷提高,電子電器產(chǎn)品逐漸成為生活的必需品。它不僅給人們的生活帶來了巨大的便利,也帶來了電子廢棄物這一新型污染物。我國己經(jīng)進(jìn)入了電子電器產(chǎn)品報(bào)廢的高峰期,同時,大量的國外電子廢棄物侵入我國,因此,我國面臨著電子廢棄物來源“內(nèi)憂外患”的困境。此外,電子廢棄物的回收處理方面卻一直處于無序狀態(tài),這讓我國的電子廢棄物回收處理體系面臨著嚴(yán)峻的考驗(yàn)。只有對電子廢棄物進(jìn)行有序的回收利用和科學(xué)處置,才能保護(hù)環(huán)境、節(jié)約資源,才符合我國走可持續(xù)發(fā)展道路,發(fā)展循環(huán)經(jīng)濟(jì),貫徹落實(shí)科學(xué)發(fā)展觀的要求。所以,制定電子廢棄物回收處理的專門法律體系勢在必行。 本文梳理了歐美、德日等發(fā)達(dá)國家和地區(qū)的相關(guān)法律制度和實(shí)踐狀況,總結(jié)國外電子廢棄物立法管理值得我國借鑒的做法;分析了我國電子廢棄物回收處理的狀況,尋找我國電子廢棄物回收處理立法存在的不足;再從可持續(xù)發(fā)展理論、環(huán)境權(quán)和循環(huán)經(jīng)濟(jì)理論的角度尋求對電子廢棄物回收處理法律制度的理論支持;論述如何完善我國電子廢棄物回收處理的法律體系;最后探討完善我國電子廢棄物回收處理法律制度的對策,以期為我國電子廢棄物回收處理法律制度的構(gòu)建做一些有益探索。 本文按照“提出問題—分析問題—解決問題”的思路,運(yùn)用比較分析法對我國電子廢棄物回收處理法律制度進(jìn)行探討,將文章分為五個部分: 第一章是緒論,主要分析了電子廢棄物產(chǎn)生的背景,介紹了研究電子廢棄物回收處理的目的和意義;第二章是電子廢棄物回收處理的現(xiàn)狀分析,界定了電子廢棄物的概念,闡明了電子廢棄物的內(nèi)涵和種類特征,分析了電子廢棄物具有數(shù)量大、資源性、復(fù)雜性等特征,列舉了電子廢棄物回收處理不當(dāng)可能產(chǎn)生的危害;第三章剖析了我國電子廢棄物回收處理的立法狀況。主要分析了我國立法中關(guān)于電子廢棄物回收處理的規(guī)定,指出了我國立法對于電子廢棄物回收處理的創(chuàng)新和不足之處;第四章介紹了國外電子廢棄物回收處理法律制度。歐美、德日等國家都對電子廢棄物給予高度的關(guān)注,紛紛立法構(gòu)建電子廢棄物回收處理的法律體系,很多地方值得我國參考借鑒。但是,在借鑒國外經(jīng)驗(yàn)的同時,要結(jié)合我國的基本國情,不能照單全收。別的國家做法不一定適合我國,在他們國家是先進(jìn)的、好的,在我們國家就一定能行得通,要結(jié)合我國的發(fā)展水平和文化傳統(tǒng),適當(dāng)?shù)慕梃b;第五章探討了我國電子廢棄物回收處理的法律完善,是本文的重點(diǎn),也是創(chuàng)新點(diǎn)所在。 由于本人的水平有限,雖然對電子廢棄物回收處理的立法完善做出了一定的分析,但還存在不足之處,希望在各位老師的指導(dǎo)下,在今后的學(xué)習(xí)研究中進(jìn)一步加強(qiáng)。
[Abstract]:With the overall development of our country's economy and society and the continuous improvement of people's living standards, electronic and electrical products have gradually become the necessities of life. It not only brings great convenience to people's lives, but also brings electronic waste as a new pollutant. The amount of foreign electronic waste invades our country. Therefore, our country is facing the dilemma of "internal trouble and external suffering" of the source of electronic waste. In addition, the recycling of electronic waste has been in a disorderly state, which makes China's electronic waste recycling system face a severe test. In order to protect the environment and save the resources, only in order to protect the environment and save the resources, can we meet our country's sustainable development road, develop the circular economy and implement the requirements of the Scientific Outlook on Development. Therefore, it is imperative to establish a special legal system for the recovery and treatment of electronic waste.
This article combs the relevant legal system and practice status of Europe and America, Germany and Japan and other developed countries and regions, summarizes the practice of foreign electronic waste legislation and management, analyzes the situation of the recycling of electronic waste in China, and finds the shortcomings of the legislation of the recycling of electronic waste in our country; and then from the theory of sustainable development, The theory of environmental rights and circular economy seeks to support the theoretical support of the legal system for the recovery and treatment of electronic waste, and discusses how to improve the legal system of the recycling of electronic waste in China, and finally discusses the countermeasures to improve the legal system of the recovery and treatment of electronic waste in our country, with a view to the legal system of the recycling of electronic waste in China. Some useful exploration is made in the construction.
In accordance with the idea of "putting forward questions - analyzing problems - solving problems", this paper uses comparative analysis method to discuss the legal system of electronic waste recycling in China, and divides the article into five parts.
The first chapter is the introduction, which mainly analyzes the background of electronic waste production, introduces the purpose and significance of studying the recycling of electronic waste. The second chapter is the analysis of the status of electronic waste recycling, defines the concept of electronic waste, clarifies the internal and type characteristics of electronic waste, and analyses the number of electronic waste. In the third chapter, the article analyzes the legislative situation of the recycling of electronic waste in China. It mainly analyzes the regulations on the recycling of electronic waste in our country's legislation, and points out the legislation of our country for the recycling of electronic waste. The fourth chapter introduces the legal system of the recovery and treatment of electronic waste abroad. The countries such as Europe, America, Germany and Japan give high attention to electronic waste, and have legislated to construct the legal system of electronic waste recycling. Many places are worthy of reference in our country. However, we should combine the experience of foreign countries and combine with me. The basic national conditions of the country can not be fully collected. Other national practices are not necessarily suitable for our country. In their country, it is advanced and good. In our country, it is bound to be able to work through the development level and cultural tradition of our country. The fifth chapter discusses the legal perfection of the waste recycling treatment in China, which is the focus of this article. It's also the point of innovation.
Because of my limited level, although we have made a certain analysis of the legislative perfection of the electronic waste recycling, there are still shortcomings. I hope that under the guidance of the teachers, we should further strengthen the study in the future.
