【摘要】： 循環(huán)經(jīng)濟(jì)是可持續(xù)發(fā)展從理念到制度的重要成果之一,在其發(fā)展過程中,法律是促進(jìn)和保障其順利發(fā)展的有效手段。將循環(huán)經(jīng)濟(jì)的立法理念貫徹于循環(huán)經(jīng)濟(jì)立法實(shí)踐之中,以法制為支撐來實(shí)現(xiàn)循環(huán)經(jīng)濟(jì)的穩(wěn)定發(fā)展,是循環(huán)經(jīng)濟(jì)發(fā)展的內(nèi)在要求。隨著我國(guó)《循環(huán)經(jīng)濟(jì)促進(jìn)法》的頒布實(shí)施,標(biāo)志著我國(guó)的循環(huán)經(jīng)濟(jì)步入了法制化管理的軌道。這將為促進(jìn)我國(guó)經(jīng)濟(jì)增長(zhǎng)模式轉(zhuǎn)變,進(jìn)一步加強(qiáng)環(huán)境保護(hù)提供法律保障。與此同時(shí),全國(guó)很多地方也在醞釀制定相應(yīng)的循環(huán)經(jīng)濟(jì)法規(guī)。 山西作為我國(guó)重要的能源化工基地,煤炭資源的大規(guī)模、高強(qiáng)度開發(fā)建設(shè),為國(guó)家經(jīng)濟(jì)高速發(fā)展提供了能源保障,但同時(shí),這種以煤炭、冶金、電力、化工為主體的高耗能產(chǎn)業(yè)結(jié)構(gòu),使山西本來就脆弱的生態(tài)環(huán)境不堪重負(fù)。因此如何立足資源優(yōu)勢(shì),發(fā)展高效能產(chǎn)業(yè),制定符合山西實(shí)際情況的循環(huán)經(jīng)濟(jì)地方立法,促進(jìn)經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展就成為了山西循環(huán)經(jīng)濟(jì)立法工作的重點(diǎn)。山西循環(huán)經(jīng)濟(jì)立法框架的構(gòu)建,應(yīng)當(dāng)考慮各方面的因素,統(tǒng)籌兼顧,應(yīng)當(dāng)與國(guó)家循環(huán)經(jīng)濟(jì)法律相銜接,應(yīng)當(dāng)反應(yīng)山西循環(huán)經(jīng)濟(jì)發(fā)展對(duì)立法的需求,體現(xiàn)出國(guó)際上循環(huán)經(jīng)濟(jì)立法發(fā)展的趨勢(shì),將制度建設(shè)貫徹于循環(huán)經(jīng)濟(jì)建設(shè)的全過程,以指導(dǎo)地方循環(huán)經(jīng)濟(jì)立法實(shí)踐。在內(nèi)容體系的構(gòu)建上,應(yīng)當(dāng)結(jié)合山西經(jīng)濟(jì)社會(huì)發(fā)展的現(xiàn)狀,加快重點(diǎn)企業(yè)管理制度、市場(chǎng)準(zhǔn)入制度、生態(tài)園區(qū)建設(shè)制度、綠色消費(fèi)制度、科技創(chuàng)新制度、循環(huán)經(jīng)濟(jì)規(guī)劃制度、循環(huán)經(jīng)濟(jì)績(jī)效評(píng)價(jià)制度、以生產(chǎn)者為主的責(zé)任延伸制度以及公眾參與制度的建設(shè)。
[Abstract]:Circular economy is one of the important achievements of sustainable development from concept to system. In the process of its development, law is an effective means to promote and guarantee its smooth development. It is the inherent requirement of circular economy development to carry out the legislative idea of circular economy in the legislative practice of circular economy and to realize the stable development of circular economy based on the legal system. With the promulgation and implementation of the Circular economy Promotion Law, China's circular economy has entered the track of legalized management. This will promote the transformation of China's economic growth model and further strengthen environmental protection to provide legal protection. At the same time, many parts of the country are also brewing to formulate the corresponding circular economy laws and regulations. Shanxi is an important base of energy and chemical industry in our country. The large-scale and high-intensity development and construction of coal resources provide energy security for the rapid development of the national economy. But at the same time, this kind of coal, metallurgy, electricity, Chemical industry as the main body of high energy-consuming industrial structure, Shanxi is already fragile ecological environment unbearable. Therefore, how to base on the advantage of resources, develop high efficiency industry, make local legislation of circular economy in accordance with the actual situation of Shanxi, and promote the sustainable development of economy and society has become the focal point of the legislation of circular economy in Shanxi. The construction of the legislative framework of Shanxi circular economy should take into account various factors, make overall plans, link up with the laws of the national circular economy, and reflect the legislative needs of the development of Shanxi's circular economy. In order to guide local circular economy legislation practice, the system construction should be carried out in the whole process of circular economy construction in order to reflect the trend of international circular economy legislation development. In the construction of content system, we should combine the present situation of Shanxi's economic and social development, accelerate the key enterprise management system, market access system, ecological park construction system, green consumption system, science and technology innovation system, circular economy planning system. The performance evaluation system of circular economy, the extension system of producer-oriented responsibility and the construction of public participation system.
