【摘要】： 生態(tài)系統(tǒng)為經(jīng)濟發(fā)展和人們生活提供原材料的支持,是整個社會持續(xù)發(fā)展的物質(zhì)基礎(chǔ)。長期以來對在旅游開發(fā)中的過度開發(fā)行為已經(jīng)影響到生態(tài)系統(tǒng)自身的再生能力,對受損的生態(tài)環(huán)境進行維護以恢復其生態(tài)功能和價值是實現(xiàn)可持續(xù)發(fā)展的要求,由受益者對生態(tài)建設(shè)中的利益損失者進行補償也符合公平正義的原則。生態(tài)補償已經(jīng)成為經(jīng)濟法學、生態(tài)學、環(huán)境管理學、旅游管理學以及可持續(xù)發(fā)展領(lǐng)域研究的熱點問題。 本文從法律制度的層面上對在旅游開發(fā)中的生態(tài)環(huán)境補償機制進行研究,全文由3個部分構(gòu)成。 第一部分,詳細介紹了旅游開發(fā)中的生態(tài)環(huán)境補償機制的概念及其性質(zhì)特征,指出旅游開發(fā)的中的生態(tài)環(huán)境補償是在旅游開發(fā)的過程中,通過對相關(guān)的主體進行補償,來彌補損失或提高收益,已達到維持和改善生態(tài)服務(wù),并對生態(tài)環(huán)境補償機制進行了理論分析,闡述了“外部效應(yīng)理論、公共物品理論以及生態(tài)環(huán)境補償機制的法律關(guān)系�！� 第二部分,以蓮花湖旅游風景區(qū)為例,介紹了我國生態(tài)環(huán)境補償機制的現(xiàn)狀,并從法學和經(jīng)濟學的視角對生態(tài)環(huán)境補償機制的不足進行分析,提出我國旅游開發(fā)中的生態(tài)環(huán)境補償機制不足的原因。 第三部分,主要談如何構(gòu)建我國的生態(tài)環(huán)境補償機制。闡述了我國旅游開發(fā)中的生態(tài)環(huán)境補償機制的構(gòu)建的各個組成部分,主要包括補償?shù)谋匾?補償原則,補償?shù)闹黧w及對象、補償?shù)臉藴屎脱a償方式,最后談到了在構(gòu)建生態(tài)環(huán)境補償機制時我們需要注意的有關(guān)問題,對構(gòu)建我國旅游開發(fā)中的生態(tài)環(huán)境補償機制提出了建議。
[Abstract]:The ecological system provides raw material support for the economic development and people's life, is the material basis of social development for a long time. The excessive development of behavior in the tourism development has affected the regeneration capacity of the ecosystem itself, to maintain the damaged ecological environment to restore its ecological function and value is required to achieve sustainable development and by the beneficiaries of the ecological building benefit loss compensation is also in line with the principle of fairness and justice. The ecological compensation has become the economic law, ecology, environmental management, a hot topic of tourism management and sustainable development research.
This paper studies the ecological environment compensation mechanism in tourism development from the legal system level. The full text is composed of 3 parts.
The first part introduces the concept of ecological compensation mechanism in tourism development and its characteristics, pointed out that the ecological environment of tourism development in the compensation is in the process of tourism development, through the compensation of the subject, to compensate for the loss or increase revenue, has reached to maintain and improve the ecological services, and the compensation mechanism the ecological environment is analyzed in theory, expounds the "externality theory, public goods theory and the legal relationship of ecological compensation mechanism"
The second part, taking Lianhua Lake Scenic Area as an example, introduces the current situation of our eco environmental compensation mechanism, and analyzes the deficiency of the compensation mechanism from the perspective of law and economics, and puts forward the reasons for the insufficient compensation mechanism of eco-environment in China's tourism development.
The third part mainly talks about how to build the ecological environment compensation mechanism in our country. This paper expounds the compensation mechanism of ecological environment of China's tourism development in the construction of various components, including the necessity, compensation principle, subject and object of compensation, compensation standard and compensation mode, finally talked about the problems in the construction the compensation mechanism of ecological environment we need to pay attention to the construction of the compensation mechanism of ecological environment, tourism development in China and puts forward some suggestions.
