【摘要】：隨著我國城鎮(zhèn)化的不斷推進(jìn)，在片面追求經(jīng)濟(jì)利益理念的驅(qū)使下，造成了日益嚴(yán)重的耕地污染問題。雖然我們有《環(huán)境保護(hù)法》、《農(nóng)業(yè)法》等諸多法律規(guī)范，但是由于我國缺乏專門性的防治耕地污染的法律規(guī)范，使得我們?cè)谛迯?fù)與治理被污染耕地的過程中，面臨種種難題。日益嚴(yán)峻的耕地污染現(xiàn)實(shí)，迫使我們不斷反思自己的行為，促使我們不斷發(fā)展完善耕地污染防治立法。本文主要從如何構(gòu)建我國耕地污染防治立法出發(fā)，根據(jù)現(xiàn)狀，，分析原因，借鑒域外的先進(jìn)典型，以期促進(jìn)我國的耕地污染防治工作。 本文在緒論部分對(duì)我國耕地污染防治的研究背景、研究意義、國內(nèi)外研究綜述及研究?jī)?nèi)容方法等進(jìn)行了簡(jiǎn)要介紹，為后文的寫作奠定了理論基礎(chǔ)。筆者在本文的第二部分對(duì)耕地污染的基本情況進(jìn)行了概述，包括耕地污染的概念、特點(diǎn)、危害及成因。關(guān)于耕地污染的概念，著重從耕地污染的原因、危害及涵蓋的具體內(nèi)容等方面對(duì)耕地污染的概念進(jìn)行闡述，初步形成耕地污染的概念體系；筆者還分析了耕地污染不同的特征；耕地污染的危害表明耕地污染治理與修復(fù)的必要性；對(duì)于耕地污染的成因進(jìn)行了深層次探討，以更好的指導(dǎo)耕地污染防治實(shí)踐。本文的第三部分簡(jiǎn)要介紹了我國耕地污染防治立法的概述及評(píng)析，分別從我國耕地污染防治立法的歷史發(fā)展、現(xiàn)行立法規(guī)定進(jìn)行了分析，在此基礎(chǔ)上總結(jié)出我國耕地污染立法體系的成效，并找出不足之處。本文的第四部分是對(duì)國外先進(jìn)立法國家的經(jīng)驗(yàn)總結(jié)，以日本、美國、德國為代表進(jìn)行了簡(jiǎn)要剖析，并從中找出有助于完善我國耕地污染防治立法的有益經(jīng)驗(yàn)。本文的最后一部分是耕地污染防治立法的完善建議，主要從指導(dǎo)原則、制度設(shè)計(jì)、責(zé)任承擔(dān)、公眾參與等方面入手提出解決方案。指導(dǎo)原則方面主張借鑒國外的先進(jìn)立法原理，用新的科學(xué)理念指導(dǎo)我國的污染防治工作；制度設(shè)計(jì)上，不斷完善我國的耕地污染防治管理體制，明確職責(zé)，確保各機(jī)構(gòu)工作的高效運(yùn)轉(zhuǎn)；責(zé)任承擔(dān)上，明確了責(zé)任形式、責(zé)任承擔(dān)等方面；此外，通過不斷完善公眾參與，為耕地污染防治工作奠定群眾基礎(chǔ)。
[Abstract]:With the development of urbanization in China, the problem of cultivated land pollution is becoming more and more serious, driven by the one-sided pursuit of economic interests.Although we have many laws and regulations, such as "Environmental Protection Law" and "Agriculture Law", due to the lack of special legal norms to prevent and cure cultivated land pollution in our country, we are faced with various difficulties in the process of remediation and treatment of polluted cultivated land.The increasingly austere reality of cultivated land pollution forces us to constantly reflect on our own behavior, and impel us to develop and perfect the legislation of cultivated land pollution prevention and control.This paper starts from how to construct the legislation of cultivated land pollution prevention and control in our country, according to the present situation, analyzes the reason, draws lessons from the advanced typical outside, in order to promote the cultivated land pollution prevention and control work in our country.In the introduction part, this paper briefly introduces the research background, research significance, domestic and foreign research summary and research content methods of cultivated land pollution prevention and control in China, which lays a theoretical foundation for the later writing.In the second part of this paper, the author summarizes the basic situation of cultivated land pollution, including the concept, characteristics, harm and causes of cultivated land pollution.On the concept of cultivated land pollution, the author expounds the concept of cultivated land pollution from the aspects of the reason, harm and concrete content of cultivated land pollution, and forms the concept system of cultivated land pollution, and analyzes the different characteristics of cultivated land pollution.The harm of cultivated land pollution indicates the necessity of cultivated land pollution treatment and remediation, and the causes of cultivated land pollution are deeply discussed in order to better guide the practice of cultivated land pollution prevention and control.The third part of this paper briefly introduces the summary and analysis of the legislation on the prevention and control of cultivated land pollution in China, and analyzes the historical development of the legislation on the prevention and control of cultivated land pollution in China, as well as the current legislative provisions.On this basis, the paper summarizes the effect of our country's cultivated land pollution legislation system, and finds out the inadequacies.The fourth part of this paper is a summary of the experience of foreign advanced legislation countries, with Japan, the United States, Germany as the representative of a brief analysis, and find out the helpful experience to improve the legislation of cultivated land pollution prevention and control in China.The last part of this paper is the suggestion of improving the legislation of the prevention and control of cultivated land pollution, mainly from the guiding principles, system design, responsibility, public participation and other aspects of the solution.In terms of guiding principles, we should draw lessons from foreign advanced legislative principles and use new scientific concepts to guide our country's pollution prevention and control work; in system design, we should constantly perfect our country's management system for the prevention and control of cultivated land pollution, and make clear our duties and responsibilities.In order to ensure the efficient operation of the work of various organizations, the form of responsibility and the responsibility assumption are clearly defined on the assumption of responsibility. In addition, through the continuous improvement of public participation, the mass foundation for the prevention and control of cultivated land pollution is laid.
