【摘要】：城市固體廢棄物來源于城市生產(chǎn)活動與城市日常生活,是產(chǎn)生環(huán)境惡化、資源緊缺等環(huán)境問題的元兇之一,已經(jīng)嚴(yán)重危及到經(jīng)濟(jì)與社會的可持續(xù)發(fā)展。為構(gòu)建資源節(jié)約型、環(huán)境友好型、循環(huán)型社會,實(shí)現(xiàn)生態(tài)文明與可持續(xù)發(fā)展,我國需要對城市固體廢棄物利用方式進(jìn)行革新,摒棄以往城市固體廢棄物的末端處置方式,采用城市固體廢棄物循環(huán)利用方式,進(jìn)而實(shí)現(xiàn)經(jīng)濟(jì)效益與環(huán)境效益同步提高,循環(huán)經(jīng)濟(jì)型社會成功構(gòu)建的目標(biāo)。我國城市固體廢棄物循環(huán)利用法制存在相關(guān)立法未充分落實(shí)循環(huán)經(jīng)濟(jì)理念,固體廢棄物循環(huán)利用法制體系不完善,專項(xiàng)立法、地方立法缺失,循環(huán)利用法律制度缺失及固體廢棄物循環(huán)利用法律措施缺乏強(qiáng)制性等問題。通過對國外固體廢棄物循環(huán)利用法制先進(jìn)經(jīng)驗(yàn)的研究,發(fā)現(xiàn)德國在固體廢棄物循環(huán)利用領(lǐng)域循環(huán)利用法律體系完善,在處置手段上注重應(yīng)用市場手段,而美國的固體廢棄物循環(huán)利用法制專項(xiàng)立法齊備、源頭預(yù)防理念清晰、清潔生產(chǎn)立法經(jīng)驗(yàn)成熟,借鑒這兩個(gè)國家的城市固體廢棄物循環(huán)利用先進(jìn)法制經(jīng)驗(yàn),立足我國城市廢棄物循環(huán)利用的基本現(xiàn)實(shí),結(jié)合我國現(xiàn)有城市固體廢棄物相關(guān)法制現(xiàn)狀及問題的分析,提出從相關(guān)立法應(yīng)該貫徹落實(shí)循環(huán)經(jīng)濟(jì)理念,完善我國城市固體廢棄物循環(huán)利用法律體系,加強(qiáng)專項(xiàng)立法與地方立法,完善我國城市固體廢棄物循環(huán)利用的基本法律制度及提高我國城市固體廢棄物循環(huán)利用法律措施的強(qiáng)制性等方面入手對我國城市固體廢棄物循環(huán)利用法律制度進(jìn)行完善的建議。
[Abstract]:The municipal solid waste comes from the urban production activities and the daily life of the city. It is one of the main culprits of the environmental problems, such as the environmental deterioration and the shortage of resources, which has seriously endangered the sustainable development of the economy and society. In order to realize ecological civilization and sustainable development, China needs to innovate the utilization mode of urban solid waste and abandon the way of the end disposal of urban solid waste, which is environment-friendly, circular society, and ecological civilization and sustainable development. The circular utilization mode of municipal solid waste is adopted to realize the simultaneous improvement of economic and environmental benefits. The goal of the successful construction of the circular economy society. The legislation of recycling utilization of municipal solid waste in our country has not fully implemented the concept of circular economy, the legal system of recycling utilization of solid waste is not perfect, the special legislation and the local legislation are missing. The lack of legal system for recycling and the lack of mandatory legal measures for recycling of solid waste. Through the study of advanced experience in the legal system of recycling and utilization of solid waste abroad, It is found that Germany has perfect legal system of recycling and utilization in the field of recycling of solid waste, and pays attention to the application of market means in the means of disposal, while the special legislation on the legal system of recycling and utilization of solid waste in the United States is complete, and the concept of source prevention is clear. The legislation experience of cleaner production is mature, the advanced legal experience of recycling and utilization of municipal solid waste in these two countries is used for reference, and based on the basic reality of recycling and utilization of urban waste in our country, Based on the analysis of the current situation and problems of the legal system related to urban solid waste in China, this paper puts forward that the relevant legislation should carry out the concept of circular economy and perfect the legal system of recycling and utilization of urban solid waste in China. Strengthening special and local legislation, Some suggestions on perfecting the legal system of recycling and utilization of urban solid waste in China are put forward in the aspects of perfecting the basic legal system of recycling and utilization of urban solid waste and the mandatory legal measures of recycling utilization of urban solid waste in China.
