【摘要】:戰(zhàn)略環(huán)境影響評(píng)價(jià)制度,是環(huán)境影響評(píng)價(jià)制度在立法建議或法律草案、政策、計(jì)劃、規(guī)劃等政府宏觀決策層次上的應(yīng)用,是指與社會(huì)經(jīng)濟(jì)發(fā)展有關(guān)的立法建議或法律草案、政策、計(jì)劃、規(guī)劃等的制定過(guò)程中對(duì)擬議草案以及所有的可替代方案可能產(chǎn)生的環(huán)境影響運(yùn)用科學(xué)知識(shí)以及專業(yè)技術(shù)進(jìn)行分析論證,從而選取對(duì)環(huán)境影響最小的最優(yōu)方案,并對(duì)可能產(chǎn)生的不良環(huán)境影響預(yù)先進(jìn)行部署的一系列過(guò)程的規(guī)范。與項(xiàng)目環(huán)境影響評(píng)價(jià)相比,戰(zhàn)略活動(dòng)對(duì)環(huán)境造成的不良影響具有巨大、廣泛、持久的特點(diǎn)。而且具體建設(shè)項(xiàng)目均是依據(jù)法律、政策、規(guī)章等制定的,是對(duì)規(guī)劃、計(jì)劃的具體落實(shí),在法律、政策、計(jì)劃、規(guī)劃等存在潛在重大不良環(huán)境影響的條件下,具體建設(shè)項(xiàng)目的環(huán)境效益更是難以保障。因此,戰(zhàn)略環(huán)境影響評(píng)價(jià)制度,是從決策源頭防控環(huán)境污染和生態(tài)破壞的重大舉措,對(duì)于促進(jìn)我國(guó)經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展具有重大意義。 我國(guó)《環(huán)境影響評(píng)價(jià)法》和《規(guī)劃環(huán)境影響評(píng)價(jià)條例》是我國(guó)戰(zhàn)略環(huán)境影響評(píng)價(jià)的主要法律依據(jù)。由于我國(guó)戰(zhàn)略環(huán)境影響評(píng)價(jià)的立法處于起步階段,與發(fā)達(dá)國(guó)家相比還存在諸多不足,,如我國(guó)僅僅確立了對(duì)規(guī)劃開展環(huán)境影響評(píng)價(jià),評(píng)價(jià)對(duì)象的范圍過(guò)窄;環(huán)境保護(hù)部門召集的審查小組的獨(dú)立性欠缺,使得審查結(jié)論的公正性和客觀性難以得到保障;由于公眾參與的技術(shù)化規(guī)定缺乏,影響了我國(guó)戰(zhàn)略環(huán)境影響評(píng)價(jià)中公眾參與質(zhì)量的提高;評(píng)價(jià)報(bào)告書的內(nèi)容缺乏替代方案,造成對(duì)替代方案的考慮效果不理想。本文采用比較研究的方法,在介紹美國(guó)、俄羅斯、加拿大等戰(zhàn)略環(huán)境影響評(píng)價(jià)方面的法律制度的基礎(chǔ)上,針對(duì)以上不足,從擴(kuò)大評(píng)價(jià)對(duì)象的范圍、提高審查主體的獨(dú)立性和權(quán)威性、提高公眾參與質(zhì)量、完善環(huán)評(píng)報(bào)告書的內(nèi)容等幾個(gè)方面提出完善我國(guó)戰(zhàn)略環(huán)境影響評(píng)價(jià)制度的建議。
[Abstract]:The strategic environmental impact assessment system is the application of the environmental impact assessment system at the level of legislative proposals or draft laws, policies, plans, plans, etc., which refers to legislative proposals or draft laws related to social and economic development. In the process of formulating policies, plans, plans, etc., scientific knowledge and expertise are used to analyze and demonstrate the proposed draft and all possible environmental impacts of alternatives, so as to select the optimal scheme with the least impact on the environment. And the specification of a series of pre-deployment processes for possible adverse environmental impacts. Compared with environmental impact assessment of projects, the adverse effects of strategic activities on the environment are enormous and widespread. Lasting characteristics. Moreover, specific construction projects are formulated in accordance with laws, policies, regulations, etc., are specific to the planning and implementation of plans, under conditions of potentially significant adverse environmental impacts such as laws, policies, plans and plans, Therefore, the strategic environmental impact assessment system is an important measure to prevent and control environmental pollution and ecological damage from the decision-making source, which is of great significance to promote the sustainable development of our country's economy and society. The Law on Environmental impact Assessment and the regulations on Planning Environmental impact Assessment are the main legal basis for strategic environmental impact assessment in China. Since the legislation of strategic environmental impact assessment in China is in its infancy, Compared with the developed countries, there are still many shortcomings, such as our country has only established the environmental impact assessment of the planning, the scope of the evaluation object is too narrow, the independence of the review group convened by the environmental protection department is not enough. This makes it difficult to guarantee the impartiality and objectivity of the conclusions of the review; because of the lack of technical provisions for public participation, it affects the improvement of the quality of public participation in the strategic environmental impact assessment of our country; the contents of the evaluation report lack of alternative schemes. This paper introduces the legal system of strategic environmental impact assessment in the United States, Russia, Canada and so on. Suggestions on how to improve the strategic environmental impact assessment system in China are put forward from several aspects, such as expanding the scope of the evaluation object, improving the independence and authority of the subject, improving the quality of public participation, and perfecting the contents of the EIA report.
