【摘要】：相較一般的民事權(quán)益減損,農(nóng)民因填涂造地而減損的生態(tài)環(huán)境權(quán)益表現(xiàn)為明顯的"二元性",即受損權(quán)益性質(zhì)的二元性、受損權(quán)益時(shí)空的二元性、權(quán)益減損范圍的二元性、受損權(quán)益內(nèi)容的二元性和責(zé)任主體的二元性。有鑒于此,填涂造地過程中農(nóng)民生態(tài)環(huán)境權(quán)益減損的法律矯正,就不能局限于對(duì)私權(quán)益受損的民法矯正。但是,既有法律矯正體系卻未能完全匹配填涂造地過程中農(nóng)民生態(tài)環(huán)境權(quán)益減損的"二元性"特點(diǎn),應(yīng)從發(fā)展農(nóng)村、農(nóng)民社會(huì)組織,整合分散配置的行政規(guī)劃?rùn)?quán),完善既有生態(tài)環(huán)境損害補(bǔ)償制度,塑造以農(nóng)民表達(dá)權(quán)為核心的程序法治,建立社會(huì)化生態(tài)環(huán)境損害矯正機(jī)制等方面入手加以完善。
[Abstract]:Compared with ordinary civil rights and interests, the ecological and environmental rights and interests of farmers, which are reduced by land reclamation, are obviously "dualistic", that is, the duality of the nature of the damaged rights and interests, the duality of the time and space of the damaged rights and interests, and the duality of the scope of the derogation of the rights and interests. In view of the duality of the contents of the damaged rights and interests and the duality of the responsible subjects, the legal correction of the derogation of the farmers' ecological environmental rights and interests in the process of filling and reclaiming land cannot be limited to the civil law correction of the damage to the private rights and interests. The existing legal correction system fails to fully match the "duality" characteristic of the abatement of farmers' ecological environmental rights and interests in the process of land filling and construction. It is necessary to develop the rural areas, farmers' social organizations, and integrate the decentralized allocation of administrative planning rights. It is necessary to perfect the compensation system of existing ecological environment damage, mold the procedure rule of law with the core of farmers' right of expression, and establish the mechanism of correction of socialized ecological environment damage.
