【摘要】：正【裁判要旨】租賃承包經(jīng)營活動中,參照招投標法采用招投標形式進行招租的,在自然人不符合法定投標人主體資格的情形下,不適用招投標法的規(guī)定。在此前提下,招投標過程中涉及定金、押金、保證金等情形的,應根據(jù)款項性質(zhì)適用擔保法或合同法相關規(guī)定。
[Abstract]:The provisions of the tendering Law shall not apply in the event that natural persons do not meet the qualification of legal bidders in the case of tendering and tendering in the form of tendering and tendering according to the tendering and tendering law in the activities of leasing and contracting operations in the light of the tendering and tendering law.
