　　摘要

　　目前，跨界水資源成為各國爭奪的熱點和重點，使各國的國際關(guān)系逐漸白熱化甚至導(dǎo)致國際沖突的發(fā)生。主要是由于關(guān)于跨界水資源利用的國際法規(guī)制存在一些的不足和問題，，本文通過研究跨界水資源利用的國際法規(guī)制的現(xiàn)狀、存在的問題及提出相應(yīng)的完善措施與建議，從而緩解各國的爭端沖突并促進(jìn)國際社會的和諧發(fā)展。最后從跨界水資源利用的國際法規(guī)制問題來反思我國關(guān)于此部分的做法問題與啟示，幫助我國更好的利用跨界水資源，減少與鄰國的沖突。

　　本文以跨界水資源利用的國際法規(guī)制研究為主線，共分為五章內(nèi)容。第一章在于研究跨界水資源利用的概況，分別從跨界地表水及跨界地下水利用形式來說明跨界水資源利用的重要性，并指出在跨界水資源利用中的國際法規(guī)制現(xiàn)狀即第二章，第二章是從歷史的維度來探討國際水資源法發(fā)展進(jìn)程，從而了解跨界水資源利用的國際法規(guī)制現(xiàn)狀。第三章是在第一章和第二章的基礎(chǔ)上，分別分析絕對主權(quán)原則與限制主權(quán)原則的矛盾沖突、國際水法碎片化與法律統(tǒng)一完整性的矛盾沖突、公平合理利用原則與無害使用原則的矛盾沖突、爭端解決的政治方法與法律方法的矛盾沖突，來發(fā)現(xiàn)跨界水資源利用的國際法規(guī)制所存在的問題。第四章是在第三章所發(fā)現(xiàn)的問題的基礎(chǔ)上研究出跨界水資源利用的國際法規(guī)制的相關(guān)完善措施，并提出相關(guān)建議。第五章則是從國際角度出發(fā)轉(zhuǎn)向我國在跨界水資源利用中的一系列國際法問題。

　　ABSTRACT

　　At present, boundary water resources has become the Hotpoint and focus in allof the countries in the world, the international relations become more and moreintense and even cause international conflict. Mainly because of shortcomings andproblems in many international legal regulation of water resources utilization ofcross-border, the existing problems and put forward corresponding measures andsuggestions to improve the present situation, the rules of international law onboundary water resources utilization, in order to ease the conflicts in differentcountries and to promote the harmonious development of the international community.

　　Finally, problems and Enlightenment on the part of the reflection of our country fromthe international law problem of water resources utilization of cross-border,cross-border use of water resources to help China better, reduce conflict withneighboring countries, to help China gain a firm foothold in the National Forest of theworld, to promote China's sustainable economic development.

　　In order to study the regulation of international law on the use of boundarywaters as the main line, is divided into five chapters. The first chapter is the overviewof boundary water resources utilization, respectively from the surface water andgroundwater use cross-border cross-border to illustrate the importance of cross-borderwater resources utilization, and points out that in the trans boundary water resourceutilization in international law regulation of the status duo is the second chapter, thesecond chapter is from the historical dimension of international water resources lawdevelopment. In order to understand the rules of international law the status of waterresources utilization of boundary. The third chapter is on the basis of the first chapterand the second chapter, the conflict and political methods analysis of absolutesovereignty principle and the principle of the sovereignty of the conflict, restriction ofinternational water law fragmented and the integrity of the unification of law ofcontradiction and conflict, and the conflict and dispute and the principle of the use ofthe principle of harmless solution and method of the law, to discover the regulation ofboundary water resources utilization of the international law issues. The fourthchapter is the basis of the third chapter of the problems found in the research on therelevant measures to improve the regulation of international law on the use of waterresources of the cross, and puts forward related suggestions. The fifth chapter is fromthe international perspective to our country in boundary water resource utilization in aseries of problems of international law.
