情態(tài)作為人際功能的主要語(yǔ)義載體,獲得了超越邏輯和傳統(tǒng)語(yǔ)法的重要地位。如今,它受到世界上語(yǔ)言學(xué)家的廣泛關(guān)注,并多在文學(xué)作品或一般立法語(yǔ)篇比如國(guó)內(nèi)法法律語(yǔ)篇中被分析。作為國(guó)際法的淵源之一,國(guó)際公約在制定及實(shí)施方式上有別于一般立法文本。因此,作者打算探究國(guó)際公約中的情態(tài),并將《聯(lián)合國(guó)反腐敗公約》作為研究課題。該公約是否運(yùn)用了情態(tài)?如果有,其情態(tài)是否具有一些獨(dú)特的特征?帶著這些問(wèn)題,本文作者展開(kāi)了下面的研究。本文研究的目的在于描述公約中情態(tài)系統(tǒng)的具體特征,探索公約中情態(tài)系統(tǒng)揭示出的人際意義,為從語(yǔ)言視角分析國(guó)際公約提供一個(gè)理論框架和實(shí)用性參考,并促進(jìn)語(yǔ)言學(xué)家和法律專家的合作以改善法律的制定狀況。概括起來(lái),本文進(jìn)行的研究可分成兩部分。第一部分是第二章,主要對(duì)本論文所涉及的理論進(jìn)行回顧,包括國(guó)內(nèi)外對(duì)情態(tài)的研究狀況,系統(tǒng)功能語(yǔ)法理論以及法律語(yǔ)篇分析。通過(guò)對(duì)這些內(nèi)容的介紹,形成了本研究的理論框架。本研究的第二部分由第三章至第五章組成,主要根據(jù)第一部分討論的框架分析公約中的情態(tài)系統(tǒng)。韓禮德的情態(tài)理論為研究語(yǔ)篇中的情態(tài)提供了全面的理論框架,基于該理論作者在第三章主要分析了公約中的情態(tài)表達(dá)式。通過(guò)分析發(fā)現(xiàn),...
