中菲南海爭議海域漁業(yè)糾紛研究

中菲南海爭議海域既包括與南沙群島主權(quán)爭議相伴而生的爭議海域,還包括臺灣島與菲律賓群島之間的重疊海域。與爭議海域有關(guān)的漁業(yè)管理活動和經(jīng)政府授權(quán)的私人漁業(yè)活動不僅是國家行使管轄權(quán)的體現(xiàn),也是對爭議領(lǐng)土實施有效占領(lǐng)的重要證據(jù)。由于爭議海域的漁業(yè)糾紛涉及爭端方之間的管轄權(quán)或者領(lǐng)土主權(quán),其解決過程中極易發(fā)生法律和政治沖突。1997年"菲律賓訴賈祟缺等人非法入境"案、2013年"廣大興28號"漁船案以及2014年"瓊瓊海09063號"漁船案充分體現(xiàn)了爭議海域漁業(yè)糾紛法律性和政治性兼具的特性。中菲可以通過合作調(diào)解分歧,促進雙方在爭議海域漁業(yè)糾紛的解決。
