【摘要】：WTO及其《SPS協(xié)定》允許成員方為保護(hù)人類(lèi)生命健康采取動(dòng)植物衛(wèi)生檢疫措施即SPS措施,但對(duì)此設(shè)立了嚴(yán)格的條件,其核心為"風(fēng)險(xiǎn)評(píng)估"。風(fēng)險(xiǎn)評(píng)估是風(fēng)險(xiǎn)管理的一部分,多年來(lái),"量化風(fēng)險(xiǎn)方法"和"整體風(fēng)險(xiǎn)方法"及其之間的博弈主導(dǎo)著風(fēng)險(xiǎn)管理學(xué)界的主流話語(yǔ)。受此影響,WTO爭(zhēng)端解決機(jī)構(gòu)在適用和解釋《SPS協(xié)定》、尤其是其中一些核心概念時(shí),不斷搖擺于這兩種方法之間,至今未有定論。即使是在新近的代表性案例"美、加繼續(xù)中止案"中,上訴機(jī)構(gòu)前所未有地表現(xiàn)出了對(duì)整體風(fēng)險(xiǎn)方法的明顯的、全面的傾向性,這是否意味著"二元化"解釋就此徹底終結(jié),猶未可知且令人生疑。這種"二元化"解釋造成了SPS措施個(gè)案裁決的不確定性,也造成了WTO爭(zhēng)端解決機(jī)構(gòu)內(nèi)部的不一致和自相矛盾。這一困境顯示出,WTO必須盡早確立其風(fēng)險(xiǎn)管理哲學(xué),并在其體制下賦予各國(guó)的SPS措施以確定的、適當(dāng)?shù)暮戏ㄐ浴?br/>[Abstract]:WTO and its SPS Agreement allow members to take phytosanitary and phytosanitary measures, that is, SPS measures, to protect human life and health, but strict conditions have been set up, the core of which is "risk assessment". Risk assessment is a part of risk management. For many years, the game between "quantitative risk method" and "overall risk method" has dominated the mainstream discourse in the field of risk management. As a result, the WTO dispute settlement body has not yet reached a conclusion when it applies and interprets the SPS Agreement, especially some of its core concepts, between the two methods. Even in the recent representative case of "the United States, Canada continues to suspend the case," the appellate body has never shown an obvious and comprehensive tendency to the overall risk approach, which means that the "dualization" interpretation is completely over, which is still unknown and questionable. This kind of "dualization" interpretation causes the uncertainty of the case decision of SPS measures, and also causes the inconsistency and contradiction within the WTO dispute settlement body. This dilemma shows that WTO must establish its risk management philosophy as soon as possible and give SPS measures to countries under its system to determine and appropriate legitimacy.
