【摘要】：文法解釋方法、整體解釋方法、目的解釋方法和歷史解釋方法是專家組和上訴機構解釋WTO各涵蓋協定的具體方法。本文考查專家組和上訴機構在反補貼案件中對四種解釋方法的運用,并通過對反補貼案件DSB報告的實證研究來歸納四種解釋方法在運用于SCM協定時,諸如字典及其含義選擇、上下文范圍確定等方面的特點。
[Abstract]:The grammar interpretation method, the overall interpretation method, the purpose interpretation method and the historical interpretation method are the specific methods for the expert group and the appellant body to interpret the WTO coverage agreements. This paper examines the application of four interpretation methods in countervailing cases by expert groups and appellants, and sums up the characteristics of the four interpretation methods when applied to SCM agreements, such as dictionaries and their meaning choices, and the determination of context, through the empirical study of DSB reports on countervailing cases.
