【摘要】：地理標(biāo)志保護(hù)是知識產(chǎn)權(quán)保護(hù)的重要內(nèi)容，隨著世界貿(mào)易的發(fā)展和各國經(jīng)濟(jì)聯(lián)系的日益緊密，，世界各國紛紛建立起適合本國國情和利益需要的地理標(biāo)志保護(hù)制度。 我國是一個疆域廣大、歷史悠久的文明古國，擁有許多具有鮮明地方特色的產(chǎn)品。用地理標(biāo)志制度保護(hù)這些特色產(chǎn)品，對于農(nóng)村經(jīng)濟(jì)的發(fā)展、農(nóng)民收入的增加以及消費者利益的保護(hù)都有重要意義。目前我國有工商、質(zhì)檢、農(nóng)業(yè)三個部門參與到地理標(biāo)志的認(rèn)定與保護(hù)工作中，形成了三套保護(hù)制度，但是這三套制度之間缺乏溝通和協(xié)調(diào)，多重保護(hù)非但未能使我國的地理標(biāo)志資源得到更好的利用，反而給地理標(biāo)志所有人和消費者造成了不必要的困擾。如何整合三個部門的資源，理順各部門的協(xié)調(diào)關(guān)系，是更好地保護(hù)地理標(biāo)志所亟待解決的問題。 本文主要介紹了地理標(biāo)志相關(guān)概念、國際法保護(hù)和當(dāng)今世界主要的保護(hù)模式，回顧了我國地理標(biāo)志保護(hù)體系的變遷，分析了目前我國三套地理標(biāo)志保護(hù)制度存在的主要問題，并結(jié)合我國國情，提出了改進(jìn)地理標(biāo)志保護(hù)體系的意見。
[Abstract]:Geographical indication protection is an important part of intellectual property rights protection. with the development of world trade and the increasingly close economic ties among countries, countries all over the world have established a geographical indication protection system suitable for their own national conditions and interests. China is an ancient civilization with a wide territory and a long history, with many products with distinctive local characteristics. It is of great significance to protect these characteristic products with geographical indication system for the development of rural economy, the increase of farmers' income and the protection of consumers' interests. At present, three departments of industry and commerce, quality inspection and agriculture are involved in the identification and protection of geographical indications, and three sets of protection systems have been formed, but there is a lack of communication and coordination among these three systems. Instead of making better use of geographical indication resources in our country, multiple protection has caused unnecessary problems to the owners and consumers of geographical indications. How to integrate the resources of the three departments and straighten out the coordination relationship of each department is an urgent problem to be solved to better protect geographical indications. This paper mainly introduces the related concepts of geographical indications, the protection of international law and the main protection modes in the world, reviews the changes of the protection system of geographical indications in China, analyzes the main problems existing in three sets of protection systems of geographical indications in China at present, and puts forward some suggestions for improving the protection system of geographical indications according to the national conditions of our country.
