【摘要】：世界銀行采購(gòu)政策是一個(gè)包含了各種規(guī)范性文件在內(nèi)的一攬子制度安排,對(duì)國(guó)際招投標(biāo)法律制度產(chǎn)生了重要影響;利益沖突規(guī)則是其中一個(gè)重要的規(guī)則,主要包括三個(gè)方面:貸款項(xiàng)目咨詢顧問聘請(qǐng)中的利益沖突規(guī)則、土建工程投標(biāo)人的利益沖突規(guī)則和招標(biāo)評(píng)標(biāo)中的利益沖突規(guī)則;本文對(duì)前兩個(gè)方面的利益沖突規(guī)則作了介紹和分析,并對(duì)我國(guó)相關(guān)立法如何借鑒該規(guī)則提出了若干建議。
[Abstract]:The World Bank's procurement policy is a package of system, including various normative documents, which has an important impact on the legal system of international bidding and tendering;Conflict of interest rules are one of the most important rules, mainly including the conflict of interest rules in the engagement of the project consultant, the conflict of interest rules of civil engineering bidders and the rules of interest in the bid evaluation;This paper introduces and analyzes the rules of conflict of interest in the first two aspects, and puts forward some suggestions on how to use the relevant legislation of our country.
