【摘要】：隨著難民問題獲得越來越多的關注,如何定義難民,或者說何者可以成為難民,在各國可以享有難民權利,已經成為各國難民體系中最為基礎的研究問題�；趪H法的角度,本文以有關難民最主要的法律文件《關于難民地位的公約》和《關于難民地位的議定書》為基本依據(jù)入手,輔之以歐美主要國家有關難民的法律規(guī)定,試圖探討現(xiàn)行難民法中存在的法律問題。本文除了緒論部分外,主要圍繞難民身份認定的實體條件、難民身份認定程序上的法律問題等方面展開,分為四個部分。第一章是關于難民問題的概述。主要介紹難民的發(fā)展、難民的種類、以及難民身份認定的意義。第二章的主題是難民身份認定的實體條件,主要分析了難民身份的認定、排除和終止條件。在難民身份認定的實體條件問題中主要闡述了國際組織和各個國家依據(jù)的法律規(guī)定和判斷,對難民身份認定實體條件作出評價,并提出了完善問題的建議。第三章探討難民身份認定程序問題,主要分析了聯(lián)合國難民組織和典型國家關于難民身份認定程序的規(guī)定,以及難民不推回原則在難民身份認定中發(fā)揮的作用,最后提出關于解決難民身份認定程序問題的建議。第四章是有關我國難民身份認定的法律完善建議。結合我國難民身份認定的現(xiàn)狀,借鑒現(xiàn)有的國際難民法,提出有關中國難民身份認定的實體條件和程序條件的設想。提倡建立健全中國難民法體系、難民法實施細則等法律法規(guī),為應對日漸突出的難民問題做好充分的法律支撐。
[Abstract]:With more and more attention to the problem of refugees, how to define refugees, or who can become refugees, can enjoy the rights of refugees in various countries, has become the most basic research issue in the refugee system of various countries. From the point of view of international law, this paper starts with the most important legal documents relating to refugees, the Convention relating to the status of refugees and the Protocol relating to the status of refugees, supplemented by the legal provisions on refugees in major countries in Europe and the United States. This paper attempts to explore the legal problems existing in the current refugee law. In addition to the introduction part, this paper mainly focuses on the substantive conditions of refugee status identification, the legal issues in the procedure of refugee status identification and so on, which is divided into four parts. The first chapter is an overview of the problem of refugees. This paper mainly introduces the development of refugees, the types of refugees, and the significance of the identification of refugees. The theme of the second chapter is the substantive conditions of the identification of refugee status, which mainly analyzes the identification, exclusion and termination of the status of refugees. In the issue of substantive conditions of refugee status identification, this paper mainly expounds the legal provisions and judgments of international organizations and various countries, evaluates the substantive conditions of refugee status identification, and puts forward some suggestions for perfecting the problems. The third chapter discusses the procedure of refugee status identification, mainly analyzes the provisions of the United Nations refugee organizations and typical countries on the procedure of refugee status identification, and the role of the principle of non-refoulement of refugees in the identification of refugee status. Finally, some suggestions on solving the procedural problems of refugee status identification are put forward. The fourth chapter is about the legal improvement suggestions on the identification of refugee status in our country. Combined with the present situation of the identification of refugee status in China and drawing lessons from the existing international refugee law, this paper puts forward some ideas about the substantive and procedural conditions of the identification of the status of refugees in China. We should advocate the establishment and improvement of China's refugee law system, rules for the implementation of refugee law, and other laws and regulations, so as to provide adequate legal support to deal with the increasingly prominent problem of refugees.
