【摘要】：面對(duì)教育服務(wù)貿(mào)易全球化趨勢(shì)的不斷加強(qiáng),各成員都試圖在自身現(xiàn)實(shí)需求與利益保護(hù)之間尋求市場(chǎng)準(zhǔn)入的平衡。但在多邊貿(mào)易規(guī)則體系下,不同利益群體之間仍存在復(fù)雜的分歧與博弈,教育服務(wù)貿(mào)易市場(chǎng)準(zhǔn)入的發(fā)展還面臨諸多法律壁壘。未來(lái)要想有所突破,應(yīng)充分利用好當(dāng)前多邊貿(mào)易規(guī)則體系的已有平臺(tái),發(fā)揮其它國(guó)際性、區(qū)域性公約和雙邊協(xié)議的作用,繼續(xù)完善國(guó)內(nèi)教育服務(wù)貿(mào)易涉外法律體系。而我國(guó)也應(yīng)利用現(xiàn)有規(guī)則,適度開(kāi)放,完善法規(guī)體系,建立與自身發(fā)展需要相適應(yīng)的教育服務(wù)貿(mào)易法規(guī)體系。
[Abstract]:In the face of the strengthening of the globalization trend of educational service trade, each member tries to seek the balance of market access between their own realistic needs and the protection of interests. However, under the multilateral trade rule system, there are still complex differences and games among different interest groups, and the development of market access to educational services trade is still facing many legal barriers. In order to make a breakthrough in the future, we should make full use of the existing platforms of the current multilateral trade rule system, give full play to the role of other international and regional conventions and bilateral agreements, and continue to improve the foreign-related legal system of domestic trade in educational services. Our country should also make use of the existing rules, moderately open, perfect the legal system, and establish the legal system of educational service trade in accordance with the needs of our own development.
