【摘要】：人類目前已經(jīng)進入風險社會,外空環(huán)境保護已經(jīng)成為全球性風險問題之一,其嚴重影響到人類的生存和國際社會的安全。風險社會中的外空環(huán)境污染具有特殊性,風險社會的來臨為外空環(huán)境法律保護提出了很多挑戰(zhàn)。以空間碎片為主要污染形式的外空環(huán)境治理,最終要依賴堅實的理論基礎(chǔ),適應(yīng)風險社會的理念和價值觀才是設(shè)計良好法律制度的先決條件。只有轉(zhuǎn)變既有的法律理念和價值觀,才能建構(gòu)起完善的外空環(huán)境法律保護制度。"世界共生"理念為外空環(huán)境保護立法提供了新的價值觀。
[Abstract]:At present, mankind has entered a risk society, and outer space environmental protection has become one of the global risk problems, which seriously affects the survival of human beings and the security of the international community. The pollution of outer space environment in the risk society has its particularity. The coming of risk society poses many challenges for the legal protection of outer space environment. Space debris as the main form of pollution in outer space environmental governance, ultimately depends on a solid theoretical basis, adapting to the concept and values of risk society is the prerequisite for the design of a good legal system. Only by changing the existing legal ideas and values, can we construct a perfect legal protection system of outer space environment, and the concept of "world symbiosis" provides new values for the legislation of outer space environmental protection.
