【摘要】：本文對(duì)金磚國(guó)家在世界貿(mào)易組織(WTO)爭(zhēng)端解決機(jī)制中的參與情況進(jìn)行了評(píng)價(jià),其目的是為了評(píng)估金磚國(guó)家對(duì)維護(hù)和加強(qiáng)多邊貿(mào)易治理平臺(tái)中已經(jīng)起到的和可能起到的作用。通過(guò)對(duì)金磚國(guó)家在WTO爭(zhēng)端解決機(jī)制中的表現(xiàn)進(jìn)行詳細(xì)的定量、定性分析,本文論證了金磚國(guó)家并不像其他許多新興經(jīng)濟(jì)體對(duì)待爭(zhēng)端解決機(jī)制采取消極態(tài)度,而是在很大程度上成功地克服了參與WTO爭(zhēng)端解決機(jī)制的障礙,并且積極運(yùn)用該機(jī)制保護(hù)國(guó)家的貿(mào)易利益。雖然主要是作為第三方積極參與,但是金磚國(guó)家在彼此有"互動(dòng)"的大部分案例中都采取一致的立場(chǎng)。本文還研究了金磚國(guó)家通過(guò)私營(yíng)企業(yè)和其他利益相關(guān)者參與,進(jìn)一步協(xié)調(diào)其在WTO爭(zhēng)端解決機(jī)制中的各種活動(dòng)的未來(lái)方向。這種協(xié)調(diào)能夠產(chǎn)生非常必要的協(xié)同效益,為解決貿(mào)易爭(zhēng)端和澄清世貿(mào)組織的貿(mào)易規(guī)則提供便利。
[Abstract]:This paper evaluates the participation of BRICS countries in the (WTO) dispute settlement mechanism of the World Trade Organization (WTO) in order to assess the role that BRICS countries have played and may play in maintaining and strengthening the multilateral trade governance platform. Through a detailed quantitative and qualitative analysis of the performance of the BRICS countries in the WTO dispute settlement mechanism, this paper demonstrates that the BRICS countries do not adopt a negative attitude towards the dispute settlement mechanism like many other emerging economies. But successfully overcome the barriers to participate in the WTO dispute settlement mechanism, and actively use the mechanism to protect the trade interests of the country. While actively engaged primarily as third parties, the BRICS have adopted a consistent position in most cases of "interaction" with each other. This paper also studies the future direction of BRICS countries' activities in the WTO dispute settlement mechanism through the participation of private enterprises and other stakeholders. Such coordination can generate the necessary synergies to facilitate the settlement of trade disputes and clarification of WTO trade rules.
