【摘要】：隨著新技術(shù)的發(fā)展,現(xiàn)有的表演者權(quán)制度不能適應(yīng)保護(hù)表演者利益的需要,世界知識(shí)產(chǎn)權(quán)組織擬定了《音像表演條約》對(duì)現(xiàn)有制度進(jìn)行了改革,擴(kuò)大了表演者的權(quán)利。我國(guó)著作權(quán)制度與該條約的規(guī)定存在一定的差異,不能充分保護(hù)表演者的利益,有必要對(duì)表演者的定義、表演者的精神權(quán)利和財(cái)產(chǎn)權(quán)利、權(quán)利的讓與等問(wèn)題進(jìn)行修訂,以促進(jìn)我國(guó)文化產(chǎn)業(yè)的發(fā)展。
[Abstract]:With the development of the new technology, the existing system of the performer's rights can't meet the needs of the protection of the performer's interests, the World Intellectual Property Organization has developed the reform the existing system, and expanded the performer's rights. There are some differences between the copyright system of our country and the provisions of the treaty, and the interests of the performers can not be adequately protected. It is necessary to revise the definition of the performer, the moral rights of the performer and the property right and the right, so as to promote the development of the cultural industry in our country.
