【摘要】：本文通過評(píng)析2008年通過的關(guān)于合同之債準(zhǔn)據(jù)法的《羅馬Ⅰ規(guī)則》的主要內(nèi)容,探討歐共體國際私法的最新發(fā)展,指出《羅馬Ⅰ規(guī)則》的可取之處主要在于增加了在確定合同之債準(zhǔn)據(jù)法方面的安定性和可預(yù)見性,并在立法技術(shù)上順應(yīng)了當(dāng)代國際私法的發(fā)展趨勢。對(duì)于正在進(jìn)行的中國國際私法典編纂而言,《羅馬Ⅰ規(guī)則》在關(guān)于合同事項(xiàng)的沖突規(guī)則方面可資借鑒。
[Abstract]:This paper discusses the latest development of the private international law of the European Community by analyzing the main contents of the Rome I Rule on the applicable Law of contract obligations adopted in 2008. It is pointed out that the merit of "Rome I Rule" mainly lies in increasing the stability and predictability in determining the applicable law of contract debt, and complying with the development trend of contemporary private international law in legislative technology. For the current compilation of the Chinese Private International Law Code, the Rome I rules can be used for reference in the conflict rules on contract matters.
