【摘要】：近年來,伴隨著中國(guó)經(jīng)濟(jì)的全面崛起,整個(gè)國(guó)家對(duì)能源的需求總量急劇上升,能源投資在中國(guó)海外投資中占一半以上,是其中最重要的部分。中國(guó)第一次出現(xiàn)了大規(guī)模的海外能源投資浪潮。這是中國(guó)崛起成為世界經(jīng)濟(jì)大國(guó)的一個(gè)必經(jīng)發(fā)展階段。改革開放30余年來中國(guó)經(jīng)濟(jì)取得了巨大的成功,已經(jīng)成為世界第二經(jīng)濟(jì)大國(guó)和貿(mào)易大國(guó)。經(jīng)濟(jì)全球化形成了新的國(guó)際分工鏈,中國(guó)成為其中處于中高耗能耗原材料的低端制造業(yè)中心,中國(guó)的制成品大量出口世界各國(guó)進(jìn)行消費(fèi),加速了中國(guó)能源和原材料的消耗。中國(guó)自身也適逢經(jīng)濟(jì)高速增長(zhǎng)期,基礎(chǔ)建設(shè)、住宅建設(shè)以及公共設(shè)施建設(shè)正大規(guī)模展開,消費(fèi)模式不斷升級(jí)。這種能源消耗井噴式增長(zhǎng),使中國(guó)陷入了嚴(yán)重的能源短缺狀態(tài)。 于是越來越多的企業(yè)將資金投入到海外能源開發(fā)領(lǐng)域,走出國(guó)門,向海外能源進(jìn)軍,但是過程并不是一帆風(fēng)順的,由于世界上多數(shù)國(guó)家,特別是發(fā)展中國(guó)家把能源主權(quán)作為維系國(guó)家經(jīng)濟(jì)和生存安全的最后屏障,一系列大規(guī)模的海外能源投資戰(zhàn)略引起了東道國(guó)對(duì)國(guó)家安全的擔(dān)憂,同時(shí)遭遇到了東道國(guó)的越來越多的政策性和法律性障礙,因此若能解決好中國(guó)海外能源投資中出現(xiàn)的問題,做到未雨綢繆,提出一些實(shí)用性的創(chuàng)新性建議則可使我國(guó)的對(duì)外能源投資更為順利。 本文綜合采用比較分析、實(shí)證分析方法、理論聯(lián)系實(shí)際的研究方法首先對(duì)海外能源投資的概念,基本方式和意義做了介紹,然后通過介紹海外國(guó)家的比較成熟的能源機(jī)制和進(jìn)行比較、解讀,基于此在法律層面上對(duì)于完善我國(guó)的海外能源投資中遇到的一系列問題加以分析并有針對(duì)性的逐一提出了解決的對(duì)策。 全文分為四個(gè)部分： 第一部分首先介紹了外能源投資的概念,基本方式,必要性和意義；第二部分在介紹了中國(guó)能源投資現(xiàn)狀基礎(chǔ)上提出其中遇到的問題和困境；第三部分介紹了海外國(guó)家美國(guó),日本和韓國(guó)的能源戰(zhàn)略,他們相對(duì)來說比較成熟,值得分析和借鑒；第四部分有針對(duì)性的提出了完善我國(guó)的海外能源投資中遇到的一系列問題加以分析并有針對(duì)性的逐一提出了解決的對(duì)策。
[Abstract]:In recent years, with the overall rise of China's economy, the total demand for energy in the whole country has risen sharply, and energy investment accounts for more than half of China's overseas investment, which is the most important part. For the first time, China has seen a massive wave of overseas energy investment. This is China's rise to become a world economic power a necessary stage of development. China's economy has achieved great success in the past 30 years since the reform and opening up, and has become the second largest economic country and the largest trading country in the world. Economic globalization has formed a new international division of labor chain, and China has become the center of low-end manufacturing industry which is in the middle and high energy consumption raw materials. China's manufactured goods are exported to all countries in the world for consumption, which accelerates the consumption of energy and raw materials in China. China itself comes at a time of rapid economic growth, with infrastructure, housing and public infrastructure building expanding on a large scale and consumption patterns escalating. This blowout growth in energy consumption has plunged China into a severe energy shortage. As a result, more and more enterprises put their funds into the field of overseas energy development, going abroad and marching into overseas energy. But the process was not smooth, because most countries in the world, In particular, developing countries regard energy sovereignty as the last barrier to maintaining national economic and survival security. A series of large-scale overseas energy investment strategies have aroused the host country's concern for national security. At the same time, it has encountered more and more policy and legal obstacles from the host country. Therefore, if we can solve the problems arising from China's overseas energy investment and plan ahead of time, Some practical and innovative suggestions can make China's foreign energy investment more smooth. This paper introduces the concept, basic methods and significance of overseas energy investment by means of comparative analysis, empirical analysis, theory and practice. Then, by introducing and comparing the relatively mature energy mechanisms of overseas countries, Based on this, this paper analyzes a series of problems encountered in perfecting our country's overseas energy investment on the legal level and puts forward some countermeasures to solve them one by one. The paper is divided into four parts: the first part introduces the concept, basic ways, necessity and significance of foreign energy investment, the second part puts forward the problems and difficulties on the basis of introducing the current situation of energy investment in China. The third part introduces the energy strategies of the United States, Japan and South Korea, which are relatively mature and worthy of analysis and reference. The fourth part puts forward a series of problems in improving our country's overseas energy investment and puts forward the countermeasures one by one.
