局部戰(zhàn)爭的難民權利保護問題研究

【摘要】：由于國際難民法在理論和實踐均尚不完善,故筆者認為難民權利的保護問題仍是國際法學領域里研究的重要內(nèi)容之一。本學位論文由前言、正文和結語三部分構成。前言部分結合當下“整體和平、局部動蕩”的國際社會大背景,簡述局部戰(zhàn)爭下難民權利保護的現(xiàn)狀。 正文分為四個部分：第一部分主要闡述難民的歷史淵源,難民定義經(jīng)歷三個階段的演進,難民身份取得及喪失等問題,并結合與難民權利聯(lián)系較為緊密的國際人權法和戰(zhàn)爭與武裝沖突法加以論述。第二部分針對難民權利保護問題,側(cè)重從理論和實踐上論述難民權利保護的國際法原則,國際社會及部分國家對難民權利保護所作的努力。第三部分為重點部分,主要論述局部戰(zhàn)爭下難民權利的保護問題,并就近年來發(fā)生局部戰(zhàn)爭地區(qū)的難民狀況為背景具體闡述其生存權、健康權等權利保護以及接納國對其接納與遣返的相關法律制度。第四部分以朝鮮半島武裝沖突為切入點探討中國在朝鮮半島可能發(fā)生戰(zhàn)爭時大量入境的朝鮮難民權利保護的對策,同時就中國構建難民權利保護的相關法律制度提出若干建議。結語部分在縱觀國際社會對局部戰(zhàn)爭下難民權利保護現(xiàn)狀的基礎上,強調(diào)國與國之間的互助合作,加強國際交流,追求國際和平。 本論文的創(chuàng)新點體現(xiàn)在：第一,針對當今和未來局部戰(zhàn)爭導致的國際社會難民這一特殊群體進行專門研究,具有獨創(chuàng)性。第二,依據(jù)國際法,探討戰(zhàn)爭導致的無序入境難民的身份甄別、甄別后的適時遣返以及具有戰(zhàn)爭難民身份者在接納國所應享有的個權,并將其規(guī)范成依法有序管理,具有新穎性。第三,在中國缺失國內(nèi)難民法及朝鮮半島可能發(fā)生戰(zhàn)爭的大背景下,探索重構中國對包括戰(zhàn)爭難民在內(nèi)的所有難民權利保護的相關法律制度,具有前瞻性。
[Abstract]:Because the theory and practice of international refugee law are not perfect, the author thinks that the protection of refugee rights is still one of the important contents in the field of international law. This thesis consists of three parts: preface, text and conclusion. Based on the background of "whole peace and local turbulence", the preface describes the present situation of refugee rights protection in local war. The text is divided into four parts: the first part mainly expounds the historical origin of refugees, the evolution of refugee definition through three stages, the acquisition and loss of refugee status, and so on. International human rights law and the law of war and armed conflict, which are closely related to the rights of refugees, are also discussed. The second part focuses on the international law principles of refugee rights protection in theory and practice, and the efforts made by the international community and some countries to protect the rights of refugees. The third part focuses on the protection of the rights of refugees in local wars, and expounds their right to survival in the context of the refugee situation in areas where local wars have occurred in recent years. The protection of the right to health and the legal system of admission and repatriation by the receiving State. The fourth part takes the armed conflict on the Korean Peninsula as the starting point to discuss the countermeasures of the protection of the rights of Korean refugees who enter a large number of countries during the possible war on the Korean Peninsula, and at the same time puts forward some suggestions on the establishment of a relevant legal system for the protection of the rights of refugees in China. The conclusion part emphasizes the mutual assistance and cooperation between countries, strengthens international exchanges and pursues international peace on the basis of reviewing the status of refugee rights protection in local wars in the international community. The innovations of this thesis are as follows: first, the special research on refugees in the international community caused by local wars in the present and future is original. Secondly, to explore, in accordance with international law, the screening of the status of disordered refugees entering the country as a result of war, the timely repatriation after screening and the individual rights of persons with war refugee status in the host country, and to regulate them in an orderly manner in accordance with the law, Have novelty. Third, against the background of the absence of China's domestic refugee law and the possibility of war on the Korean Peninsula, it is forward-looking to explore and reconstruct China's relevant legal system for the protection of the rights of all refugees, including war refugees.
