【摘要】：英美學(xué)者的"不當(dāng)?shù)美泽w法"理論,主張涉外不當(dāng)?shù)美畟鶓?yīng)由其自體法支配。在不同的情勢(shì)下,自體法可以是原因合同關(guān)系準(zhǔn)據(jù)法、不動(dòng)產(chǎn)所在地法、得利地法或不當(dāng)因素產(chǎn)生地法。雖然學(xué)界對(duì)上述觀點(diǎn)褒貶不一,但其對(duì)我國(guó)不當(dāng)?shù)美麤_突立法有著現(xiàn)實(shí)的借鑒意義:原因合同關(guān)系準(zhǔn)據(jù)法主義不僅與不當(dāng)?shù)美贫鹊牡匚慌c作用相匹配,而且可以解決因識(shí)別差異導(dǎo)致的準(zhǔn)據(jù)法偏差問題;不動(dòng)產(chǎn)所在地法若隨著物權(quán)沖突規(guī)則的發(fā)展而擴(kuò)展至與動(dòng)產(chǎn)有關(guān)的不當(dāng)?shù)美?則亦可避免因識(shí)別差異導(dǎo)致的準(zhǔn)據(jù)法偏差;而至于得利地法,則已經(jīng)在大陸法系國(guó)家的早期立法中得到體現(xiàn)。此外,鑒于不當(dāng)?shù)美贫鹊暮诵氖堑美蛑徽?dāng),故將"不當(dāng)?shù)美l(fā)生地"理解為"不當(dāng)因素產(chǎn)生地",并作為指引不當(dāng)?shù)美麥?zhǔn)據(jù)法的連結(jié)點(diǎn)之一,亦可為我國(guó)立法所用。
[Abstract]:According to the theory of "unjust enrichment autologous method", British and American scholars hold that the debt of improper enrichment should be controlled by its own law. In different situations, the autologous law may be the law applicable to the contractual relationship of cause, the law of the location of immovable property, the law of enrichment or the law of the place where improper factors arise. Although the academic circles have different opinions on the above views, they have practical significance for reference to the legislation of improper enrichment conflict in our country: the doctrine of applicable law of reason contract relation not only matches the position and function of improper enrichment system, Moreover, it can solve the problem of the deviation of the applicable method caused by the difference of identification. If the law of the location of immovable property extends to the improper enrichment related to movable property with the development of the rules of conflict of rem, it can also avoid the deviation of applicable law caused by the difference of identification. As for the law of enrichment, it has been embodied in the early legislation of civil law countries. In addition, since the core of the unjust enrichment system is the improper cause of enrichment, it can be used in our legislation to interpret the "place of improper enrichment" as "the place where improper factors are produced" and to act as one of the connecting points to guide the applicable law of improper enrichment.
