【摘要】：流失文物的回歸是國際社會一直關(guān)注的文化遺產(chǎn)保護的特殊問題。但博物館的"公共性"讓館內(nèi)文物的回歸比民間文物回歸更困難;加之文物流失在二戰(zhàn)前(早于現(xiàn)有生效文物返還國際公約),使得解決二戰(zhàn)前流失于海外博物館內(nèi)文物的回歸問題成為法學界最為棘手的法律問題。此外,近些年西方博物館聯(lián)盟提出"環(huán)球博物館"概念和文物屬于"人類共同遺產(chǎn)"的論調(diào),企圖模糊二戰(zhàn)前流失文物的所有權(quán)問題,阻礙二戰(zhàn)前流失文物原屬國對此類流失文物的索討。應(yīng)以文化主權(quán)和文化權(quán)利作為該類文物回歸的國際法理論依據(jù)處理文物回歸問題,這種理論也逐步被國際組織和各國認可。
[Abstract]:The return of lost cultural relics is a special problem of cultural heritage protection that the international community has been paying close attention to. But the "publicity" of the museum makes it more difficult to return the cultural relics in the museum than the folk relics. In addition, the loss of cultural relics before World War II (earlier than the existing international convention on the return of cultural relics) makes the return of cultural relics lost in overseas museums before World War II the most thorny legal problem in the field of law. In addition, in recent years, the Western Union of Museums has proposed the concept of "Universal Museum" and that cultural relics belong to the "common heritage of mankind", in an attempt to obscure the ownership of cultural relics lost before the second World War. Prevent the loss of cultural relics before World War II, the original state of such lost cultural relics claim. Cultural sovereignty and cultural rights should be taken as the theoretical basis of international law to deal with the return of cultural relics, which is gradually recognized by international organizations and countries.
