【摘要】：知識(shí)產(chǎn)權(quán)制度是知識(shí)經(jīng)濟(jì)構(gòu)成中的重要一環(huán),在如今全球化浪潮的大背景下,知識(shí)產(chǎn)權(quán)制度的國(guó)際化趨勢(shì)日趨明顯,專利制度作為知識(shí)產(chǎn)權(quán)制度的一個(gè)重要分支,這種趨勢(shì)表現(xiàn)的尤為明顯。 以1883年締結(jié)巴黎公約為開(kāi)始,歐美先進(jìn)工業(yè)國(guó)家一直是專利制度國(guó)際化進(jìn)程的主要推手,從制訂專利制度的基本原則,到簡(jiǎn)化申請(qǐng)程序、統(tǒng)一審批手續(xù),最后發(fā)展到實(shí)體專利法的國(guó)際協(xié)調(diào),這一切都是以建立全球統(tǒng)一的專利制度為最終目標(biāo)的。《專利合作條約》是專利程序法國(guó)際化的表現(xiàn),《與貿(mào)易有關(guān)的知識(shí)產(chǎn)權(quán)協(xié)議》則既涉及程序,又涉及實(shí)體,《實(shí)體專利法條約》則是完全的專利實(shí)體法條約。 由于各國(guó)技術(shù)水平、專利法制發(fā)展程度各不相同,要實(shí)現(xiàn)實(shí)體法意義上的專利法協(xié)調(diào),任務(wù)繁復(fù)復(fù)雜,難度可想而知,本文對(duì)其中的焦點(diǎn)問(wèn)題進(jìn)行了列舉分析,比如授予專利權(quán)的實(shí)質(zhì)性條件,新穎性、創(chuàng)造性、實(shí)用性的審查標(biāo)準(zhǔn),可授予專利權(quán)的主題,對(duì)權(quán)利要求解釋的不同規(guī)定等等。 雖然實(shí)體專利法國(guó)際協(xié)調(diào)的進(jìn)程不可避免,但這一進(jìn)程也會(huì)給發(fā)展中國(guó)家的科技發(fā)展帶來(lái)不利的影響,所以發(fā)展中國(guó)家應(yīng)該相互團(tuán)結(jié),積極應(yīng)對(duì),爭(zhēng)取在國(guó)際協(xié)調(diào)的過(guò)程中為國(guó)內(nèi)專利法保留更多的自由立法空間。最后本文還提出了我國(guó)應(yīng)該如何應(yīng)對(duì)國(guó)際協(xié)調(diào)的策略,指出我國(guó)應(yīng)該在現(xiàn)有基礎(chǔ)上提高專利程序的電子化水平,加大對(duì)技術(shù)創(chuàng)新的扶持力度,增強(qiáng)創(chuàng)新能力,為以后的國(guó)際協(xié)調(diào)做好各種準(zhǔn)備。
[Abstract]:Intellectual property system is an important part of knowledge economy. Under the background of globalization, the internationalization trend of intellectual property system is becoming more and more obvious. Patent system is an important branch of intellectual property system. This trend is particularly evident. Starting with the conclusion of the Paris Convention in 1883, advanced industrial countries in Europe and the United States have been the main promoters of the process of internationalization of the patent system, from formulating the basic principles of the patent system to simplifying the application procedures and unifying the examination and approval procedures. Finally, it developed to the international coordination of substantive patent law, all of which aimed at establishing a global unified patent system. The Patent Cooperation Treaty is a manifestation of the internationalization of patent procedure law. The Agreement on Trade-Related aspects of intellectual property Rights (trips) deals with both procedures and entities, while the substantive Patent Law Treaty is a complete substantive patent law treaty. Because of the technical level of each country, the degree of development of patent legal system is different. In order to realize the coordination of patent law in the sense of substantive law, the task is complex and complicated, and the difficulty can be imagined. This paper enumerates and analyzes the key issues among them. For example, substantive conditions for granting patents, novelty, creative, practical review criteria, subject matter that can be granted patents, different requirements for interpretation of claims, and so on. Although the process of international harmonization of substantive patent laws is inevitable, it will also have a negative impact on the scientific and technological development of developing countries. Therefore, developing countries should unite with each other and actively respond to it. Strive to preserve more free legislative space for domestic patent law in the process of international coordination. Finally, this paper puts forward how to deal with the strategy of international coordination, and points out that our country should improve the electronic level of patent procedure, increase the support for technological innovation, and enhance innovation ability. Prepare for future international coordination.
