【摘要】：單一海洋劃界,主要是指當(dāng)事國(guó)遵循同一劃界規(guī)則或標(biāo)準(zhǔn),以協(xié)議或請(qǐng)求裁判的方式,對(duì)其大陸架和專屬經(jīng)濟(jì)區(qū)之間重合的權(quán)利主張重疊區(qū)域劃定一條邊界線的過程。單一海洋劃界的"單一"是其總體特征。它意味著對(duì)專屬經(jīng)濟(jì)區(qū)和大陸架的劃界應(yīng)遵循一個(gè)劃界標(biāo)準(zhǔn),意味著用一條邊界線長(zhǎng)期統(tǒng)一地劃定兩國(guó)間大陸架和專屬經(jīng)濟(jì)區(qū)的界限,意味著存在一個(gè)完全重合的權(quán)利主張重疊區(qū)域,或特殊情況下,存在一條重合的等距離線。
[Abstract]:Single maritime delimitation mainly refers to the process of drawing a boundary line between the overlapping claims between the continental shelf and the exclusive economic zone by agreement or request for adjudication by the parties following the same delimitation rules or standards. The "singularity" of single maritime delimitation is its general characteristic. It means that the delimitation of the exclusive economic zone and the continental shelf shall be governed by a delimitation standard, and that the delimitation of the continental shelf and the exclusive economic zone between the two States shall be uniformly delineated over a long period of time by a single boundary line, This means that there is a completely overlapped area of claims or, in a particular case, a coincident isometric line.
