【摘要】：共同但有區(qū)別責(zé)任是指各國對保護全球環(huán)境應(yīng)該負(fù)有共同的但是又有區(qū)別的責(zé)任。該原則經(jīng)歷了萌芽、提出并確立、細(xì)化三個發(fā)展階段,已成為國際社會公認(rèn)的保護和改善國際環(huán)境的基本原則。然而美國卻在該原則不斷深入人心的時候提出征收碳關(guān)稅,對共同但有區(qū)別原則造成了極大的沖擊�！疤缄P(guān)稅”的提出對于現(xiàn)行的貿(mào)易規(guī)則造成了一定的影響,而且這種影響是深遠(yuǎn)的,貿(mào)易規(guī)則的變化會在很大程度上影響我國經(jīng)濟貿(mào)易的發(fā)展。在環(huán)保的旗號下,碳關(guān)稅隱藏著美國為首的發(fā)達(dá)國家諸多的政治目的。碳關(guān)稅的實施利弊均有,但綜合各方面因素來看,其實施弊大于利。針對目前的情況,我國應(yīng)采取各種措施,對“碳關(guān)稅”對世界貿(mào)易規(guī)則的影響進行相應(yīng)的研究,在一定程度上預(yù)見世界貿(mào)易規(guī)則在此基礎(chǔ)上可能發(fā)生的變化,并及時調(diào)整我國的產(chǎn)業(yè)結(jié)構(gòu)。積極應(yīng)對別有用心的碳關(guān)稅措施。 針對上述分析,本文通過五大部分論述主題,第一部分論述共同但有區(qū)別責(zé)任原則的概念和歷史沿革,第二部分論述碳關(guān)稅的內(nèi)涵及其實質(zhì)分析,首先通過前兩部分的論述先對共同但有區(qū)別原則和碳關(guān)稅有一個系統(tǒng)的了解。然后第三部分是對碳關(guān)稅的合法性分析,從碳關(guān)稅的實施違反共同但有區(qū)別原則,違反WTO有關(guān)環(huán)境的原則以及違反WTO具體規(guī)則的角度分別論述,得出碳關(guān)稅不合法的結(jié)論。第四部分則論述實施碳關(guān)稅會對我國產(chǎn)生的影響,得出碳關(guān)稅的實施雖然有利有弊,但是弊大于利,從而引出第五部分我國的碳關(guān)稅應(yīng)對措施.第五部分通過論述我國應(yīng)對碳關(guān)稅的內(nèi)部措施和外部措施,為我國應(yīng)對可能到來的碳關(guān)稅征收添磚加瓦,以期我國能未雨綢繆,順利跨過西方國家設(shè)置的貿(mào)易壁壘!
[Abstract]:Common but differentiated responsibilities mean that countries should have common but differentiated responsibilities for the protection of the global environment. This principle has gone through three stages of development. It has been recognized by the international community as the basic principle of protecting and improving the international environment. However, the United States proposed a carbon tariff when the principle became more and more popular, which had a great impact on the principle of common but differentiated. The introduction of "carbon tariff" has a certain impact on the current trade rules, and this effect is far-reaching. The change of trade rules will greatly affect the development of economic and trade in China. Under the banner of environmental protection, carbon tariffs hide many political aims of the developed countries led by the United States. There are advantages and disadvantages in the implementation of carbon tariff, but according to various factors, its implementation is more harmful than good. In view of the current situation, China should take various measures to study the effect of carbon tariff on the rules of world trade, and to some extent foresee the possible changes in the rules of world trade on this basis. And timely adjustment of China's industrial structure. Actively respond to ulterior motives carbon tariff measures. In view of the above analysis, this paper discusses five major themes: the first part discusses the concept and historical evolution of the principle of common but differentiated responsibilities, the second part discusses the connotation and essential analysis of carbon tariff. First of all, through the first two parts of the discussion on the principle of common but differentiated and carbon tariffs have a systematic understanding. Then the third part is the legitimacy analysis of carbon tariff, from the implementation of carbon tariff violates the principle of common but differentiated, violates the environmental principles of WTO and violates the specific rules of WTO, and draws the conclusion that carbon tariff is illegal. The fourth part discusses the impact of the implementation of carbon tariffs on our country, the implementation of carbon tariffs, although there are advantages and disadvantages, but more harm than good, leading to the fifth part of China's carbon tariff measures. The fifth part discusses the internal and external measures of our country to deal with carbon tariffs, for China to respond to the possible carbon tariff collection, in the hope that China can prepare ahead of time, smoothly across the western countries set up trade barriers!
