【摘要】：隨著兩岸經(jīng)濟(jì)活動(dòng)越來越頻繁，政治、文化交流也日漸深入，臺(tái)灣地區(qū)與祖國大陸的聯(lián)系也日益緊密�！逗{兩岸經(jīng)濟(jì)合作框架協(xié)議》的簽訂與實(shí)施，標(biāo)志著兩岸經(jīng)濟(jì)合作和交流進(jìn)入了常態(tài)化和機(jī)制化的發(fā)展階段。本文從此協(xié)議的內(nèi)容與性質(zhì)、協(xié)議與WTO的關(guān)系、協(xié)議簽訂以后受益的實(shí)務(wù)、爭(zhēng)端解決四個(gè)方面對(duì)此協(xié)議做了較為初步的研究，著重在對(duì)其內(nèi)容和性質(zhì)研究的基礎(chǔ)上，對(duì)此協(xié)議的區(qū)域經(jīng)濟(jì)的性質(zhì)和與WTO規(guī)則的關(guān)系上，，做了一些闡述，其中，以原產(chǎn)地規(guī)則為例對(duì)協(xié)議的臨時(shí)原產(chǎn)地規(guī)則進(jìn)行了評(píng)價(jià)，此外對(duì)爭(zhēng)端解決機(jī)制的構(gòu)建也提出了建議。
[Abstract]:As economic activities between the two sides of the strait become more frequent, political and cultural exchanges are deepening, and the ties between the Taiwan region and the mainland of the motherland are becoming increasingly close. The signing and implementation of the Framework Agreement on Economic Cooperation between the two sides of the Taiwan Strait Marks the cross-straits economic cooperation and the exchange has entered the normal and the institutional development stage. In this paper, the content and nature of the agreement, the relationship between the agreement and WTO, the benefit of the agreement after the signing of the agreement, and the settlement of disputes four aspects of this agreement have been studied in this paper, focusing on the content and nature of the study. In this paper, the nature of the regional economy and the relationship between the rules of origin and the rules of WTO are discussed. Among them, the rules of origin are taken as an example to evaluate the provisional rules of origin of the agreement, and some suggestions on the construction of the dispute settlement mechanism are also put forward.
