婦女勞動(dòng)權(quán)國(guó)際保護(hù)問(wèn)題研究

【摘要】:婦女人權(quán)是在人權(quán)觀念產(chǎn)生300多年后出現(xiàn)的一個(gè)似乎含義重疊的概念,婦女勞動(dòng)權(quán)則是婦女人權(quán)的重要內(nèi)容之一。面對(duì)婦女人權(quán)的特殊性,我們僅僅研究婦女勞動(dòng)權(quán)的現(xiàn)狀,追究婦女遭受歧視的根源,討論其發(fā)展的歷史,并不能在真正意義上提升婦女的人權(quán)地位,消除婦女人權(quán)歧視。針對(duì)這一現(xiàn)象,本文以婦女勞動(dòng)權(quán)相關(guān)理論為基礎(chǔ),來(lái)探討婦女勞動(dòng)權(quán)國(guó)際保護(hù)機(jī)制,完善婦女勞動(dòng)權(quán)國(guó)際保護(hù)機(jī)制,旨在徹底改變婦女人權(quán)受歧視的地位。 婦女勞動(dòng)權(quán)的法律地位如何,其國(guó)際保護(hù)機(jī)制如何,發(fā)展到現(xiàn)在已經(jīng)成為國(guó)際社會(huì)關(guān)注的一個(gè)熱點(diǎn)問(wèn)題,把婦女勞動(dòng)權(quán)國(guó)際保護(hù)作為一種法律制度進(jìn)行專(zhuān)門(mén)研究,具有非常積極的理論價(jià)值和重要的現(xiàn)實(shí)意義。 第一章介紹了婦女勞動(dòng)權(quán)國(guó)際保護(hù)的概述。一方面,對(duì)婦女勞動(dòng)權(quán)的內(nèi)容作了界定,并探究了婦女勞動(dòng)權(quán)國(guó)際保護(hù)的必要性。另一方面,闡述了婦女勞動(dòng)權(quán)國(guó)際保護(hù)法律制度的演變。通過(guò)論證,奠定了婦女勞動(dòng)權(quán)的理論基礎(chǔ)。 第二章對(duì)婦女勞動(dòng)權(quán)國(guó)際保護(hù)機(jī)制進(jìn)行了深入地分析。婦女勞動(dòng)權(quán)國(guó)際保護(hù)機(jī)制由婦女勞動(dòng)權(quán)國(guó)際保護(hù)的立法、婦女勞動(dòng)權(quán)國(guó)際保護(hù)的機(jī)構(gòu)及婦女勞動(dòng)權(quán)的實(shí)施措施共同組成的。因此,本章從動(dòng)態(tài)的保護(hù)實(shí)施措施和靜態(tài)的保護(hù)立法及保護(hù)機(jī)構(gòu)加以闡述。 第三章闡述婦女勞動(dòng)權(quán)國(guó)際保護(hù)機(jī)制的不足。本章結(jié)合國(guó)際社會(huì)婦女勞動(dòng)權(quán)國(guó)際保護(hù)的相關(guān)立法,從婦女勞動(dòng)權(quán)的保護(hù)現(xiàn)狀出發(fā),揭示婦女勞動(dòng)權(quán)保護(hù)的種種不足,主要闡述:1.婦女勞動(dòng)權(quán)國(guó)際保護(hù)內(nèi)容的缺陷;2.婦女勞動(dòng)權(quán)國(guó)際保護(hù)執(zhí)行機(jī)制的不足。 第四章提出了完善婦女勞動(dòng)權(quán)國(guó)際保護(hù)機(jī)制的幾點(diǎn)建議。本章針對(duì)婦女勞動(dòng)權(quán)國(guó)際保護(hù)存在的不足與缺陷,從理論上和制度上提出了完善意見(jiàn)。1.完善婦女勞動(dòng)權(quán)國(guó)際保護(hù)機(jī)制的內(nèi)容,為追求婦女勞動(dòng)權(quán)實(shí)質(zhì)平等,應(yīng)完善婦女人權(quán)公約和協(xié)調(diào)國(guó)際國(guó)內(nèi)人權(quán)立法;2.加強(qiáng)婦女勞動(dòng)權(quán)國(guó)際保護(hù)機(jī)制的實(shí)施與監(jiān)督,設(shè)置專(zhuān)門(mén)機(jī)構(gòu)和限制國(guó)家的保留制度,來(lái)加強(qiáng)對(duì)婦女勞動(dòng)權(quán)國(guó)際保護(hù)的監(jiān)督。
[Abstract]:The human rights of women is a concept that appears to have overlapping meanings more than 300 years after the emergence of the concept of human rights, and the right to work of women is one of the important contents of women's human rights. In the face of the particularity of women's human rights, we can only study the present situation of women's labor rights, investigate the root causes of discrimination against women, and discuss the history of their development, which can not promote women's human rights status and eliminate women's human rights discrimination in real sense. In view of this phenomenon, based on the related theories of women's labor rights, this paper probes into the international protection mechanism of women's labour rights and consummates the international protection mechanism of women's labour rights, aiming at completely changing the status of women's human rights being discriminated against. The legal status of women's labour rights and their international protection mechanisms have now become a hot issue of concern to the international community. The international protection of women's labour rights has been specially studied as a legal system. It has very positive theoretical value and important practical significance. The first chapter introduces the international protection of women's labor rights. On the one hand, it defines the content of women's right to work, and probes into the necessity of international protection of women's right to work. On the other hand, it expounds the evolution of the international protection legal system of women's labor rights. Through argumentation, laid the theoretical foundation of women's right to work. The second chapter deeply analyzes the international protection mechanism of women's labor rights. The international protection mechanism of women's labor rights is composed of the legislation of international protection of women's rights to work, the institutions of international protection of women's rights to work and the implementation measures of women's rights to work. Therefore, this chapter from the dynamic protection implementation measures and static protection legislation and protection agencies to elaborate. The third chapter elaborates the insufficiency of the international protection mechanism of women's right to work. This chapter combines the relevant legislation of the international community women's labor rights protection, from the women's labor rights protection status quo, reveals the women's labor rights protection of various shortcomings, mainly elaborated: 1. Deficiencies in the content of International Protection of Women's Labour Rights; 2. Inadequate implementation mechanisms for the international protection of women's labour rights. The fourth chapter puts forward several suggestions to perfect the international protection mechanism of women's labor rights. This chapter aims at the deficiency and defect of the international protection of women's right to work, and puts forward some perfect suggestions in theory and system. 1. To perfect the content of the international protection mechanism of women's labor rights, we should perfect the women's human rights conventions and harmonize the international and domestic human rights legislation in order to pursue the substantive equality of women's labor rights. To strengthen the supervision of the international protection of women's labour rights, we should strengthen the implementation and supervision of the international protection mechanism of women's labour rights, set up specialized agencies and restrict the state's reservation system.
