【摘要】：隨著中國與東盟的經(jīng)濟(jì)合作加深,多邊經(jīng)濟(jì)的開放.程度已經(jīng)不.能完全適應(yīng)合作的需要,貿(mào)易領(lǐng)域亟待升級(jí)。鑒于TPP協(xié)議訂立的初衷是應(yīng)對(duì)中國經(jīng)濟(jì)模式,與中國發(fā)展方向背道而馳,中國不適于加入TPP。而東盟的RCEP協(xié)議問題重重,尚不成熟,對(duì)推動(dòng)自由貿(mào)易區(qū)發(fā)展,心有余力而不足力。發(fā)展世界共同市場不失為中國與東盟合作的第三種新方向、新路徑。建立中國—東盟共同市場需要修改原有法律文件,創(chuàng)立新的法律框架,以滿足雙方經(jīng)濟(jì)合作的需要。研究共同市場法律將為共同市場構(gòu)建奠定.制度基礎(chǔ),本文將立足于中國—東盟自由貿(mào)易區(qū)的經(jīng)濟(jì)發(fā)展及貿(mào)易投資法律實(shí)施現(xiàn)狀,借鑒吸收其他共同市場法的有.益之處,為中國—東盟共同市場.法律提出建議。本篇論文分為五個(gè)部分。緒論部分,分為三個(gè)小節(jié),分別是本文的選題意義、采用的研究方法和本文的創(chuàng)新之處。這一部分的主旨在于對(duì)論文的基本情況進(jìn)行介紹。第二部分,即第一章,開篇名義闡明構(gòu)建中國-東盟共同市場的必要性。從中國-東盟自貿(mào)區(qū)的發(fā)展問題展開,結(jié)合現(xiàn)在國際形勢對(duì)提出建立中國-東盟共同市場的緊迫性和必要性,并揭示共同市場法律是構(gòu)建共同市場的必要前提。接下來論證構(gòu)建共同市場的理論基礎(chǔ),為國內(nèi)外研究的概括闡述。以中國-東盟自由貿(mào)易區(qū)研究理論成果及西方共同市場學(xué)說為本文后續(xù)研究提供支持。第三部分,即第二章,點(diǎn)明法律制度對(duì)構(gòu)建中國-東盟共同市場的重要性。概括論。述中國-東盟自由貿(mào)易區(qū)的法律現(xiàn)狀以及存在問題的方式,。為下文闡述如何構(gòu)建共同市場法律制度作鋪墊。自由貿(mào)易區(qū)法律問題諸多,不能將每個(gè)問題都分析透徹,因此只從三個(gè)重要問題進(jìn)行分析。第四部分,即第三章,提出共同市場法律框架及上文三個(gè)具體問題的解決思路。結(jié)合歐盟法的法律框架,對(duì)中國-東盟共同市場法律框架提出建議。本章還將論述如何協(xié)調(diào)共同市場法律與WTO規(guī)則、APEC規(guī)則,以及明確共同市場法律在兩岸三地的適用規(guī)則。結(jié)語部分,對(duì)全文進(jìn)行回顧總結(jié),展望中國-東盟共同市場法制進(jìn)程,加快中國-東盟區(qū)域一體化,實(shí)現(xiàn)各國共同發(fā)展、共同繁榮。
[Abstract]:With the deepening of economic cooperation between China and ASEAN, the opening up of the multilateral economy. The degree is no longer there. Can fully adapt to the needs of cooperation, the field of trade needs to be upgraded. In view of the fact that the original intention of the TPP agreement was to deal with China's economic model and run counter to the direction of China's development, China is not suitable for joining the TPP.. However, ASEAN's RCEP agreement has many problems and is not mature enough to promote the development of free trade area. The development of the World Common Market is the third new direction and new way of cooperation between China and ASEAN. In order to meet the needs of economic cooperation between China and ASEAN, it is necessary to amend the existing legal documents and create a new legal framework for the establishment of China-ASEAN Common Market. The study of common market laws will lay the foundation for the construction of a common market. On the basis of system, this paper will be based on the economic development of China-ASEAN Free Trade area and the current situation of the implementation of trade and investment laws, and draw lessons from other common market laws. The advantage is China-ASEAN Common Market. The law makes recommendations. This paper is divided into five parts. The introduction part is divided into three sections, which are the significance of the topic, the research method and the innovation of this paper. The main purpose of this part is to introduce the basic situation of the thesis. The second part, the first chapter, clarifies the necessity of constructing China-ASEAN Common Market. Starting from the development of China-ASEAN Free Trade area and combining with the current international situation, this paper puts forward the urgency and necessity of establishing the China-ASEAN Common Market, and reveals that the common market law is the necessary prerequisite for the construction of the Common Market. Then it demonstrates the theoretical basis for the construction of common market, for the summary of domestic and foreign research. China-ASEAN Free Trade area (CAFTA) and Western Common Market theory provide support for the following research. The third part, the second chapter, points out the importance of legal system to the construction of China-ASEAN Common Market. Generality. This paper describes the current legal situation of China-ASEAN Free Trade area and the existing problems. It lays the groundwork for how to construct the legal system of common market. There are many legal problems in free trade area, so we can not analyze every problem thoroughly, so we can only analyze three important problems. The fourth part, the third chapter, puts forward the legal framework of the Common Market and the solutions to the above three specific problems. Combined with the legal framework of European Union law, the legal framework of China-ASEAN Common Market is proposed. This chapter will also discuss how to harmonize common market law with WTO rules, APEC rules, and clarify the common market laws applicable in the three mainland and mainland China. In the conclusion part, the author reviews and summarizes the full text, looks forward to the legal process of China-ASEAN Common Market, speeds up the regional integration of China and ASEAN, and realizes the common development and prosperity of all countries.
