【摘要】：條約保留是國家對條約(公約)個別條款的排除或更改,不論采用怎樣的名稱。它涉及公約當(dāng)事國權(quán)利義務(wù)關(guān)系的再次調(diào)整。對《聯(lián)合國反腐敗公約》作出的國別聲明體現(xiàn)在reservations(保留)、declarations(聲明)和notifications(通知)的名稱形態(tài)中。它們實際上可以區(qū)分為真正意義的聲明與解釋性聲明。真正意義的保留又具體可以細分為典型意義的保留和非典型意義的保留。就保留而言,必涉及保留的程序合理性,保留的后果及對我國的影響等;就解釋性聲明而言,則會有對其他國家的啟示。
[Abstract]:A reservation to a treaty is an exclusion or modification by a State of individual provisions of a treaty (Convention), whatever its name. It involves the readjustment of the relationship between the rights and obligations of the parties to the Convention. The country declarations made to UNCAC are embodied in the form of names of reservations (reservations), declarations (Declaration) and notifications (Notification). They can in fact be distinguished between declarations in their true sense and interpretative declarations. The reservation of the real meaning can be subdivided into the reservation of the typical meaning and the reservation of the atypical meaning. In the case of reservations, it must involve the procedural reasonableness of reservations, the consequences of reservations and their effects on our country; in the case of interpretative declarations, there would be implications for other States.
