【摘要】：完善我國海洋法律體系須以建設(shè)海洋強(qiáng)國為根本之著眼點,立足于為我國海洋事業(yè)的發(fā)展提供法治保障,本文分別從治理、發(fā)展和維權(quán)三大支柱入手,闡述如何革新海洋治理體制機(jī)制,建構(gòu)與完善海洋法律體系。根據(jù)"海陸統(tǒng)籌"的原則,充分認(rèn)識"區(qū)域主義路徑""整合性路徑""功能性路徑"的各自特點與優(yōu)勢,形成一個體系合理、結(jié)構(gòu)科學(xué)、內(nèi)容完備、國內(nèi)治理與國際協(xié)作均衡、統(tǒng)合符合時代發(fā)展需求、具有前瞻性的海洋法律體系。
[Abstract]:In order to perfect the marine legal system of our country, we should take the building of a strong marine power as the basic point of view, and base ourselves on providing the legal guarantee for the development of our country's marine undertakings. This paper starts with the three pillars of governance, development and safeguarding the rights of the sea. This paper expounds how to reform the system of ocean governance and how to construct and perfect the legal system of ocean. According to the principle of "overall planning of land and sea", we should fully understand the respective characteristics and advantages of "regionalism path", "integrated path" and "functional path", and form a reasonable system, scientific structure, complete content, balanced domestic governance and international cooperation. Integration meets the needs of the times and has a forward-looking marine legal system.
