【摘要】：隨著全球一體化和貿(mào)易自由化進(jìn)程的加快，國際貿(mào)易對于一個國家經(jīng)濟(jì)發(fā)展的重要性日益凸顯，而伴隨著侵犯知識產(chǎn)權(quán)的非法貨物在國際貿(mào)易中大量涌現(xiàn)，國際貿(mào)易關(guān)注的焦點也更多地聚集在知識產(chǎn)權(quán)的海關(guān)保護(hù)上。TRIPS協(xié)議產(chǎn)生后，其明確賦予海關(guān)知識產(chǎn)權(quán)執(zhí)法職能，，海關(guān)知識產(chǎn)權(quán)執(zhí)法制度成為各國應(yīng)對知識產(chǎn)權(quán)侵權(quán)的強(qiáng)力武器。歐盟有著先進(jìn)的知識產(chǎn)權(quán)立法理念及豐富的執(zhí)法經(jīng)驗，特別是在海關(guān)知識產(chǎn)權(quán)執(zhí)法方面有許多值得我國學(xué)習(xí)和借鑒的地方。 本文采用歷史研究、數(shù)據(jù)分析、案例分析以及對比分析等方法，從以下幾方面對歐盟海關(guān)知識產(chǎn)權(quán)執(zhí)法制度進(jìn)行探討。首先，采用歷史的研究方法，介紹了歐盟海關(guān)知識產(chǎn)權(quán)執(zhí)法依據(jù)的發(fā)展歷程，并分析了其相關(guān)內(nèi)容，重點介紹了歐盟知識產(chǎn)權(quán)海關(guān)保護(hù)條例和TRIPS協(xié)議；其次，運(yùn)用數(shù)據(jù)分析與案例分析的研究方法，對歐盟海關(guān)知識產(chǎn)權(quán)執(zhí)法的總體情況以及幾個典型案例進(jìn)行分析；再次，運(yùn)用對比分析法，從實體和程序方面對中歐海關(guān)知識產(chǎn)權(quán)執(zhí)法制度進(jìn)行分析，比較了兩者的差異；最后，先分析了我國海關(guān)知識產(chǎn)權(quán)執(zhí)法的現(xiàn)狀及其存在的問題，然后在結(jié)合我國國情的基礎(chǔ)上，參照歐盟海關(guān)知識產(chǎn)權(quán)執(zhí)法制度，給出對我國海關(guān)知識產(chǎn)權(quán)執(zhí)法與企業(yè)發(fā)展的啟示。
[Abstract]:With the acceleration of the process of global integration and trade liberalization, the importance of international trade to the economic development of a country is becoming increasingly prominent. The focus of international trade is also more focused on the customs protection of intellectual property rights. After the emergence of the TRIPS agreement, it clearly endows the customs with the function of intellectual property law enforcement, and the enforcement system of customs intellectual property rights becomes a powerful weapon for countries to deal with intellectual property infringement. EU has advanced intellectual property legislation concept and rich law enforcement experience, especially in customs intellectual property law enforcement, there are many worthy of our country to learn and learn from. By means of historical research, data analysis, case analysis and comparative analysis, this paper probes into the law enforcement system of customs intellectual property rights in EU from the following aspects. Firstly, using the historical research method, this paper introduces the development course of the EU Customs intellectual property Law Enforcement basis, and analyzes its relevant contents, focusing on the EU intellectual property Customs Protection regulations and the TRIPS Agreement. Using the research method of data analysis and case analysis, the general situation and several typical cases of EU customs intellectual property law enforcement are analyzed. Thirdly, the comparative analysis method is used. From the aspect of entity and procedure, this paper analyzes and compares the differences between China and Europe's customs intellectual property law enforcement system. Finally, it analyzes the current situation and existing problems of China's customs intellectual property law enforcement, and then, on the basis of combining the national conditions of our country, With reference to the EU Customs intellectual property Law Enforcement system, the enlightenment to China's Customs intellectual property Law Enforcement and Enterprise Development is given.
