【摘要】：洛克使用默示同意這一概念是為了論證領(lǐng)土主權(quán)。默示同意是指任何與國(guó)家領(lǐng)土有關(guān)的行為都受制于這個(gè)國(guó)家的法律管轄權(quán)。由默示同意支撐的義務(wù)不是明示同意支撐的政治義務(wù),而是一種狹義的法律義務(wù)。前者對(duì)應(yīng)的是政治主權(quán)這一"擬制性空間",后者對(duì)應(yīng)的是領(lǐng)土主權(quán)這一"準(zhǔn)物理性空間"。洛克的這一區(qū)分又進(jìn)一步帶來(lái)了不同公民身份的區(qū)分。這些問(wèn)題反映了洛克的自由主義國(guó)家理論中鮮為人知的一面。
[Abstract]:Locke used the concept of implied consent to justify territorial sovereignty. Implied consent means that any act relating to the territory of the State is subject to the legal jurisdiction of that State. The obligation supported by implied consent is not a political obligation supported by express consent, but a narrow legal obligation. The former corresponds to the "fictitious space" of political sovereignty, while the latter corresponds to the "quasi-physical space" of territorial sovereignty. Locke's distinction further led to the distinction of different citizenship. These problems reflect a little-known aspect of Locke's liberal state theory.
