【摘要】："無效果無報酬"原則根源于對海上財(cái)產(chǎn)的救助,是海難救助的傳統(tǒng)原則,但其卻在環(huán)境成為海難救助標(biāo)的的生態(tài)文明下遭遇到適用困境。"無效果無報酬"原則生態(tài)化的目標(biāo)是確認(rèn)海洋環(huán)境為海難救助的獨(dú)立標(biāo)的,給予獨(dú)立的環(huán)境救助報酬,以環(huán)境救助的效果大小來決定環(huán)境救助報酬的金額,并建立起環(huán)境救助費(fèi)用的保障機(jī)制。這一變化反映出海難救助的"無效果無報酬"原則已從傳統(tǒng)的單純財(cái)產(chǎn)救助向生態(tài)文明下環(huán)境救助與財(cái)產(chǎn)救助共存的方向發(fā)展的趨勢。
[Abstract]:The principle of "no effect and no reward" originates from the salvage of property at sea, which is the traditional principle of salvage at sea, but it has encountered a dilemma in the ecological civilization where the environment has become the object of salvage at sea. The ecological goal of the principle of "no effect and no reward" is to confirm the marine environment as the independent object of salvage at sea, to give independent reward for environmental rescue, and to determine the amount of compensation for environmental rescue by the effect of environmental rescue. And set up the safeguard mechanism of environmental rescue expense. This change reflects the trend that the principle of "no effect and no reward" of salvage at sea has changed from the traditional simple property rescue to the coexistence of environmental rescue and property rescue under ecological civilization.
