論我國(guó)承認(rèn)與執(zhí)行外國(guó)仲裁裁決的程序規(guī)則

【摘要】:我國(guó)是《紐約公約》的締約國(guó),對(duì)于符合《紐約公約》條件的外國(guó)仲裁裁決有義務(wù)承認(rèn)與執(zhí)行。但是,我國(guó)目前承認(rèn)與執(zhí)行外國(guó)仲裁裁決的程序規(guī)則存在著諸多弊端和立法空白,導(dǎo)致法院在審查外國(guó)仲裁裁決時(shí)無(wú)法可依、審查效率低下,當(dāng)事人的權(quán)益難以及時(shí)有效的實(shí)現(xiàn)。我國(guó)現(xiàn)行的程序規(guī)則已不能滿足司法實(shí)踐的需要,亟需完善。 本文從介紹外國(guó)仲裁裁決的不同標(biāo)準(zhǔn)入手,對(duì)文章所采外國(guó)裁決之標(biāo)準(zhǔn)進(jìn)行了界定,分析了我國(guó)目前承認(rèn)與執(zhí)行外國(guó)仲裁裁決的做法及弊端,闡述了國(guó)外先進(jìn)國(guó)家的仲裁立法,通過(guò)比較研究和實(shí)證研究,提出了完善承認(rèn)與執(zhí)行外國(guó)仲裁裁決的程序規(guī)則的建議。本文分為三章。 第一章外國(guó)仲裁裁決承認(rèn)與執(zhí)行程序規(guī)則概述。首先介紹了外國(guó)仲裁裁決認(rèn)定標(biāo)準(zhǔn),介紹了國(guó)際上和我國(guó)及本文的界定標(biāo)準(zhǔn)。其次闡述了承認(rèn)與執(zhí)行的概念和關(guān)系。最后對(duì)本文的核心概念程序規(guī)則進(jìn)行了論述,并說(shuō)明筆者采取定義的理由。 第二章我國(guó)承認(rèn)與執(zhí)行外國(guó)仲裁裁決程序規(guī)則的現(xiàn)狀及問(wèn)題。該部分全面地介紹和分析了目前我國(guó)承認(rèn)與執(zhí)行外國(guó)仲裁裁決程序規(guī)則之現(xiàn)狀及存在的問(wèn)題,包括申請(qǐng)、管轄、時(shí)限、審查范圍及內(nèi)部報(bào)告制度,分析指出了各個(gè)程序環(huán)節(jié)所暴露的弊端。 第三章完善我國(guó)承認(rèn)與執(zhí)行外國(guó)仲裁裁決程序規(guī)則的建議。本部分提出了我國(guó)承認(rèn)與執(zhí)行外國(guó)仲裁裁決的具體完善建議:規(guī)范申請(qǐng)材料、延長(zhǎng)申請(qǐng)期限、確定民事涉外庭審查、明確立案及答辯期限、限制審查范圍、構(gòu)建聽證制度、建立上訴制度,并在其中列舉了一些外國(guó)先進(jìn)國(guó)家的立法和我國(guó)的規(guī)定進(jìn)行對(duì)比,希望可以對(duì)我國(guó)的司法實(shí)踐起到一定的借鑒作用。
[Abstract]:China is a signatory to the New York Convention, and is obliged to recognize and enforce foreign arbitral awards which meet the requirements of the New York Convention. However, there are many drawbacks and legislative gaps in the rules of procedure for the recognition and enforcement of foreign arbitral awards in China at present, which leads to the inefficiency of the review of foreign arbitral awards. The rights and interests of the parties are difficult to be realized in a timely and effective manner. The current procedural rules in our country can not meet the needs of judicial practice and need to be perfected. This paper begins with the introduction of different standards of foreign arbitral awards, defines the standards adopted in the article, analyzes the practices and drawbacks of recognizing and enforcing foreign arbitral awards in China, and expounds the arbitration legislation of advanced countries abroad. Through comparative and empirical studies, this paper puts forward some suggestions on how to perfect the procedural rules for the recognition and enforcement of foreign arbitral awards. This paper is divided into three chapters. Chapter I Summary of rules of procedure for recognition and Enforcement of Foreign Arbitral Awards. First, it introduces the standards of foreign arbitration awards, the international and China, and the definition standard of this article. Secondly, it expounds the concept and relation of recognition and enforcement. Finally, this paper discusses the core concept of procedural rules, and explains the reasons for the author to take the definition. Chapter two: the status quo and problems of the rules of recognition and enforcement of foreign arbitral awards in China. This part comprehensively introduces and analyzes the current situation and existing problems of the rules of procedure for the recognition and enforcement of foreign arbitral awards in China, including application, jurisdiction, time limit, scope of review and internal reporting system. The disadvantages of each procedure are analyzed and pointed out. The third chapter consummates our country recognition and the enforcement foreign arbitration award procedure rule suggestion. In this part, the author puts forward some specific suggestions for the recognition and enforcement of foreign arbitral awards: standardizing the application materials, extending the application period, determining the civil foreign court examination, defining the time limit of filing and defending, limiting the scope of examination, and constructing the hearing system. It is hoped that the establishment of appeal system and the comparison between the legislation of some foreign advanced countries and the provisions of our country can serve as a reference for the judicial practice of our country.
