【摘要】：國(guó)家義務(wù)直接來(lái)源于公民基本權(quán)利,是公民基本權(quán)利的根本保障。然而國(guó)家義務(wù)并不是絕對(duì)的,國(guó)家義務(wù)以國(guó)家權(quán)力為運(yùn)行動(dòng)力,過(guò)度強(qiáng)調(diào)國(guó)家義務(wù)將導(dǎo)致自由喪失殆盡,強(qiáng)調(diào)基本權(quán)利研究范式轉(zhuǎn)變的同時(shí)必須研究國(guó)家義務(wù)邊界。從國(guó)家層面看,國(guó)家理性和國(guó)家能力決定了國(guó)家義務(wù)所能達(dá)到的最大場(chǎng)域;從基本權(quán)利層面看,公民基本權(quán)利的保護(hù)范圍和公民基本權(quán)利的功能是對(duì)國(guó)家義務(wù)的邊界進(jìn)一步的具體化;從具體法律原則層面看,法律保留原則、比例原則、程序正義原則與公共利益原則決定著國(guó)家的實(shí)然義務(wù)邊界。然而,確定國(guó)家義務(wù)邊界并非一蹴而就的事情,還需注意國(guó)家義務(wù)邊界是開(kāi)放的而非封閉的,確定國(guó)家義務(wù)邊界的各種機(jī)制應(yīng)有共同的目標(biāo)模式,國(guó)家保障基本權(quán)利應(yīng)適時(shí)。
[Abstract]:The state obligation comes directly from the citizen's basic rights and is the fundamental guarantee of the citizen's basic rights. However, the state obligation is not absolute. The state obligation takes the state power as the motive force, the excessive emphasis on the state obligation will lead to the loss of freedom, and the research paradigm of the basic rights must be changed at the same time it is necessary to study the boundary of the state obligation. At the national level, national rationality and national capacity determine the maximum range of State obligations that can be achieved; at the fundamental rights level, The scope of protection of the basic rights of citizens and the functions of the basic rights of citizens are further concretization of the boundaries of the state obligations; from the perspective of specific legal principles, the principle of legal reservation, the principle of proportionality, The principle of procedural justice and the principle of public interest determine the boundary of the state's actual obligation. However, it is not an easy task to determine the boundary of state obligation. It is also necessary to pay attention to the fact that the boundary of state obligation is open rather than closed. The mechanism of determining the boundary of state obligation should have a common target model, and the state should ensure the basic rights in good time.
