跨國公司社會責任的確立:基于橫向人權義務的補充分析

【摘要】：已有研究雖為確立跨國公司的社會責任奠定了某種理論基礎,但都存在諸多不足。從橫向義務的角度來分析跨國公司社會責任,可以為確立跨國公司社會責任提供一種補充性的理論框架。在橫向人權義務視角下,跨國公司社會責任的義務層次也得以明確,即保護、尊重和救濟義務。進而,通過國內法和國際法來規(guī)范跨國公司社會責任,也就具有明確的義務標準。為給中國企業(yè)在對外投資過程中承擔社會責任提供更確定、有效的指引,可以將保護、尊重和救濟義務納入國內立法及雙邊投資協(xié)定中。
[Abstract]:Although the previous studies have laid a certain theoretical foundation for establishing the social responsibility of multinational corporations, there are many deficiencies. To analyze the social responsibility of transnational corporations from the perspective of horizontal obligations can provide a complementary theoretical framework for the establishment of social responsibility of transnational corporations. From the perspective of horizontal human rights obligations, the level of social responsibility of transnational corporations can also be defined, that is, the obligation to protect, respect and remedy. Furthermore, the regulation of MNCs' social responsibility through domestic law and international law also has a clear standard of obligation. In order to provide more definite and effective guidance for Chinese enterprises to undertake social responsibility in the process of overseas investment, the obligations of protection, respect and relief can be incorporated into domestic legislation and bilateral investment agreements.
