航空產(chǎn)品責(zé)任案件管轄權(quán)的確定:美國實(shí)踐及其啟示

【摘要】：航空產(chǎn)品責(zé)任是美國乃至全球航空事故索賠訴訟的一個(gè)難題。該類案件具有顯著的國際性特征,因此決定了其國際管轄權(quán)的分配。美國法院在航空產(chǎn)品責(zé)任領(lǐng)域適用屬人管轄理論,基于當(dāng)事人和國家利益,針對(duì)四類產(chǎn)品責(zé)任案件,積極利用持續(xù)"業(yè)務(wù)活動(dòng)"聯(lián)系因素、"代理機(jī)構(gòu)"理論、"商業(yè)流通"標(biāo)準(zhǔn)、"公平正義"傳統(tǒng)觀念,抑制適用不方便法院原則,靈活調(diào)控案件,使其回歸本國管轄。中國制造的C919大飛機(jī)不久將進(jìn)入國際市場,為防范航空產(chǎn)品責(zé)任訴訟泛濫和防止與中國有關(guān)的案件流向他國法院,中國司法實(shí)踐可借鑒美國經(jīng)驗(yàn),對(duì)域外發(fā)生的航空產(chǎn)品責(zé)任案件,謹(jǐn)慎適用不方便法院原則,將其視為一種例外規(guī)則,適度擴(kuò)張管轄權(quán),做到"管""拒"自如,以保護(hù)航空器制造商和國家的核心權(quán)益。
[Abstract]:Aviation product liability is a difficult problem in American and even global aviation accident claim litigation. This kind of case has the remarkable international characteristic, therefore determines its international jurisdiction assignment. American courts apply the theory of personal jurisdiction in the field of aviation product liability. Based on the interests of the parties and the state, American courts apply to four types of product liability cases. Active use of continuous "business activities" contact factors, "agency" theory, "commercial circulation" standard, "fair and just" traditional concept, restrain the application of inconvenient court principle, flexible regulation and control of cases, so that they return to domestic jurisdiction. The C919 aircraft made in China will soon enter the international market. In order to prevent the proliferation of aviation product liability litigation and prevent the flow of China-related cases to the courts of other countries, China's judicial practice can draw lessons from the experience of the United States. In order to protect the core rights and interests of the aircraft manufacturer and the state, the principle of inconvenient court should be applied prudently in the case of aviation product liability outside the territory, which should be regarded as an exceptional rule, expand jurisdiction moderately and "refuse" freely.
