【摘要】：從國際法視角觀之,此次金融危機實為非主權者的國際力量之理性行為所導致的非理性結果,是多中心的國際立法缺少協(xié)調機制之體現(xiàn);此次金融危機也在規(guī)則創(chuàng)制、司法審查、執(zhí)行力等方面對國際法形成挑戰(zhàn)。在國際法視野中,面對金融危機的最佳對策為建立國際法治,對于國際法治中存在之不足,可以利用此次金融危機在加強國際立法民主、提高國際法院之地位、強化國際法院之強制管轄權、培養(yǎng)國際法之強制執(zhí)行機制等方面進行完善。
[Abstract]:From the perspective of international law, this financial crisis is the irrational result of the rational behavior of the international power of the non-sovereign, which is reflected by the lack of coordination mechanism of the multi-center international legislation, and the financial crisis is also being created by the rules. Judicial review, executive power and other aspects of the formation of a challenge to international law. In the field of international law, the best response to the financial crisis is to establish the international rule of law, and the deficiency in the international rule of law can be exploited to strengthen the democracy of international legislation and enhance the status of the International Court of Justice. Strengthen the compulsory jurisdiction of the International Court of Justice and train the enforcement mechanism of international law.
