【摘要】：索馬里海盜對來往商船的劫掠事件,已經(jīng)引起國際社會的高度關(guān)注。通過國際合作解決這一問題勢在必行,這就需要一定的法律依據(jù)。在此方面,國際法雖然制定了一些規(guī)范,但在實(shí)踐中也暴露出其不足之處:缺少專門的懲治海盜的國際公約,在管轄權(quán)上存在混亂現(xiàn)象。為此,必須完善國際法在懲治海盜方面的規(guī)制,如建立專門的國際公約以加強(qiáng)規(guī)制及,確立國際刑事法院對海盜犯罪的管轄權(quán),從而為國際合作打擊海盜提供法律依據(jù)。
[Abstract]:The looting of merchant ships by Somali pirates has aroused great concern from the international community. It is imperative to solve this problem through international cooperation, which needs certain legal basis. In this respect, although international law has established some norms, it has also revealed its shortcomings in practice: the lack of a special international convention to punish piracy, and the existence of confusion in jurisdiction. Therefore, it is necessary to perfect the regulation of international law on the punishment of piracy, such as establishing special international conventions to strengthen the regulation and establishing the jurisdiction of the International Criminal Court on piracy crimes, so as to provide a legal basis for international cooperation in combating piracy.
