【摘要】：吸引外國(guó)技術(shù)人才移民是各國(guó)實(shí)施爭(zhēng)奪人才戰(zhàn)略的重要手段之一,因此技術(shù)移民立法也往往是各國(guó)移民法的重點(diǎn)內(nèi)容。近幾年,中國(guó)開(kāi)始逐漸重視引進(jìn)國(guó)外人才和技術(shù)移民立法,但由于我國(guó)長(zhǎng)期以來(lái)對(duì)技術(shù)移民、世界各國(guó)技術(shù)移民法現(xiàn)狀和趨勢(shì)、中國(guó)吸引技術(shù)移民優(yōu)劣勢(shì)等關(guān)鍵問(wèn)題的理解和把握有偏差,初步建立的技術(shù)移民法律制度存在著宏觀架構(gòu)、立法思路、具體制度設(shè)計(jì)等方面的明顯缺陷。 筆者認(rèn)為加強(qiáng)中國(guó)的綜合實(shí)力,有必要完善現(xiàn)有的技術(shù)移民法律和政策,以利于中國(guó)在國(guó)際人才競(jìng)爭(zhēng)中占有一席之地。本文第一部分梳理了中國(guó)在認(rèn)識(shí)到技術(shù)移民的重要性后,頒布的有關(guān)于技術(shù)移民的政策性文件和相關(guān)立法規(guī)定,并指出了我國(guó)現(xiàn)有技術(shù)移民法律法規(guī)存在的形式和內(nèi)容問(wèn)題。第二部分選取了美國(guó)、加拿大和澳大利亞這幾個(gè)比較典型的移民國(guó)家以及和中國(guó)內(nèi)地國(guó)情較為接近的德國(guó)、香港地區(qū),闡述其技術(shù)移民立法和主要的技術(shù)移民制度。第三部分在第二部分的基礎(chǔ)上,對(duì)我國(guó)建立技術(shù)移民法作出了立法展望并提出了配套法律制度的改革趨勢(shì)。 本課題研究的創(chuàng)新點(diǎn)主要有：1、筆者對(duì)技術(shù)移民立法問(wèn)題的多方位審視和研究在國(guó)內(nèi)現(xiàn)有研究中少有涉獵；2、筆者認(rèn)識(shí)到技術(shù)移民問(wèn)題既是一個(gè)法律問(wèn)題也同時(shí)涉及國(guó)際利益等各方面的博弈,因而在技術(shù)移民法體系及配套法律制度的設(shè)計(jì)中充分考慮到政治上的因素；3、在進(jìn)行比較研究時(shí),筆者重點(diǎn)研究中國(guó)的國(guó)情和先進(jìn)經(jīng)驗(yàn)及技術(shù)的沖突和融合問(wèn)題,在制度規(guī)劃中,力求建立中國(guó)特色的技術(shù)移民法律制度。
[Abstract]:Attracting foreign skilled talent migration is one of the important means for countries to implement the strategy of scrambling for talents, so the legislation of skilled migration is often the key content of immigration laws of various countries. In recent years, China has gradually begun to attach importance to the introduction of foreign talent and technology immigration legislation. However, due to the fact that China has long been concerned about skilled migration, the current situation and trend of skilled migration laws in various countries in the world have been on the rise. There are deviations in understanding and grasping the key issues such as the advantages and disadvantages of attracting skilled migrants, and the legal system of skilled migration has obvious defects in macro structure, legislative thinking and specific system design. The author thinks that it is necessary to improve the existing laws and policies of skilled migration to strengthen the comprehensive strength of China, so that China can have a place in the international talent competition. In the first part of this paper, after recognizing the importance of skilled migration, China promulgates policy documents and relevant legislative provisions on skilled migration, and points out the forms and contents of the existing laws and regulations on skilled migration in China. In the second part, some typical immigration countries, such as America, Canada and Australia, as well as Germany and Hong Kong, which are close to the mainland of China, are selected to expound the legislation and the main system of skilled immigration. The third part, on the basis of the second part, makes the legislative prospect to establish the skilled immigration law in our country and puts forward the reform trend of the supporting legal system. The main innovation of this research is: 1. The author examines and studies the legislation of skilled migration from many aspects and rarely dabbles in the existing research in China. 2. The author realizes that the problem of skilled migration is not only a legal problem but also a game involving international interests, so the political factors are fully taken into account in the design of the legal system of skilled migration and the supporting legal system. 3. In the comparative study, the author focuses on the problems of conflict and integration of China's national conditions, advanced experience and technology, and tries to establish a legal system of skilled migration with Chinese characteristics in the planning of the system.
