【摘要】：全文包括引言、三個(gè)主文部分、結(jié)語(yǔ),共2.1萬(wàn)余字符。引言。由于《聯(lián)合國(guó)海洋法公約》并未明確規(guī)定島礁劃分標(biāo)準(zhǔn),因此關(guān)于島礁劃分問(wèn)題國(guó)際學(xué)術(shù)界、實(shí)務(wù)界存在頗多爭(zhēng)議,故從公約解釋規(guī)則、島嶼制度理論發(fā)展背景以及國(guó)際司法判例的借鑒角度研究中國(guó)太平島法律爭(zhēng)議,以證明其島嶼的法律地位,具有重要意義。一、太平島法律爭(zhēng)議之概況。太平島在南海區(qū)域具有優(yōu)越的自然地理優(yōu)勢(shì)及較高的戰(zhàn)略價(jià)值,故成為兵家必爭(zhēng)之地,歷史上曾遭七次"易手"。而菲律賓當(dāng)屬其中一大爭(zhēng)端的制造者。2013年1月,菲律賓正式啟動(dòng)了對(duì)中國(guó)關(guān)于南海問(wèn)題的強(qiáng)制仲裁一案,從而引發(fā)了對(duì)太平島法律地位的爭(zhēng)議。二、太平島法律爭(zhēng)議之評(píng)析。2013年1月,菲律賓啟動(dòng)的對(duì)中國(guó)關(guān)于南海問(wèn)題的強(qiáng)制仲裁一案,涉及到太平島的法律地位的認(rèn)定及能否主張經(jīng)濟(jì)專屬區(qū)、大陸架等相關(guān)海洋權(quán)益問(wèn)題。針對(duì)中菲太平島法律爭(zhēng)議,其焦點(diǎn)問(wèn)題在于如何定性《聯(lián)合國(guó)海洋法公約》第121條的規(guī)定。三、太平島法律爭(zhēng)議解決路徑探究。鑒于既無(wú)明確的國(guó)際規(guī)范可參考也無(wú)統(tǒng)一的國(guó)際司法判例及國(guó)家實(shí)踐可借鑒,因此筆者試圖從推進(jìn)《聯(lián)合國(guó)海洋法公約》完善、合理解釋適用角度以及其他靈活的綜合措施層面,對(duì)解決中菲太平島"島礁爭(zhēng)議"提出若干建議。結(jié)語(yǔ)。關(guān)于島礁界定問(wèn)題,在海域劃界爭(zhēng)端中普遍存在,也是首要解決的問(wèn)題。針對(duì)中菲太平島法律爭(zhēng)議,文章主要從太平島自然地理概況、權(quán)屬現(xiàn)狀及演變、爭(zhēng)議背景、爭(zhēng)議評(píng)析及解決路徑探索等方面展開(kāi)論述,還專門就太平島法律地位發(fā)表了自己見(jiàn)解。

Introduction Since the United Nations Convention on the Law of the Sea does not specify the criteria for the division of islands and reefs, there are many disputes in the international academic circles on the division of islands and reefs, so the rules of interpretation of the Convention are taken into account. It is of great significance to study the legal dispute of Taiping Island in China in order to prove its legal status. I. Overview of legal disputes in Taiping Island. Taiping Island has superior natural geographical advantage and high strategic value in the South China Sea region, so it has become a necessary place for military experts and has been changed hands seven times in history. In January 2013, the Philippines formally launched a mandatory arbitration case against China over the South China Sea, sparking a dispute over the legal status of Taiping Island. Second, comments on the legal dispute over Taiping Island. Some suggestions are put forward to resolve the dispute of islands and reefs in Taiping Island of China and Philippines from the perspective of reasonable explanation and other flexible comprehensive measures. Conclusion As for the problem of defining islands and reefs, it is the most important problem to be solved in maritime boundary disputes. In view of the legal dispute between China and Philippines Taiping Island, the article mainly discusses the natural geography of Taiping Island, the status quo and evolution of ownership, the background of the dispute, the analysis of the dispute and the exploration of the settlement path, etc. He also expressed his own opinion on the legal status of Taiping Island.
