【摘要】：國(guó)際組織作為國(guó)際法的重要主體,應(yīng)當(dāng)對(duì)其國(guó)際不法行為承擔(dān)國(guó)際責(zé)任。這也是維護(hù)穩(wěn)定和平的國(guó)際秩序的內(nèi)在要求。繼二讀通過(guò)《國(guó)家對(duì)國(guó)際不法行為的責(zé)任(草案)》后,聯(lián)合國(guó)國(guó)際法委員會(huì)已經(jīng)開始研究起草了《國(guó)際組織的責(zé)任(草案)》。鑒于國(guó)家和國(guó)際組織作為國(guó)際法主體既有共同點(diǎn)也有不同點(diǎn),相應(yīng)地,兩套草案有相似部分,也有不同的地方。中國(guó)加入了許多國(guó)際組織,為了處理將來(lái)可能發(fā)生的涉及中國(guó)的國(guó)際組織責(zé)任糾紛,我們應(yīng)當(dāng)重視對(duì)國(guó)際組織的責(zé)任規(guī)則加以研究。
[Abstract]:As an important subject of international law, international organizations should bear international responsibility for their internationally wrongful acts. This is also an inherent requirement of a stable and peaceful international order. Following the adoption on second reading of the draft responsibility of States for internationally wrongful acts, the International Law Commission of the United Nations has begun to study the drafting of the responsibility of International organizations (draft). In view of the similarities and differences between States and international organizations as subjects of international law, there are similarities and differences between the two sets of drafts. China has joined many international organizations. In order to deal with the possible disputes concerning the responsibility of international organizations in the future, we should attach importance to the study of the rules of responsibility of international organizations.
